ORD 98-04 VACATING A PORTION OF PAUL AVENUE NORTHEASTORDINANCE NO. 98-__~
AN ORDINANCE of the City of Bainbridge Island, Washington,
vacating a port'ion of Paul Avenue Northeast in the Fort Ward area
upon satisfaction of certain conditions.
WH~AS, by Resolution No. 98-01, adopted on January 5, 1998, the Ci_ty Council
initiated the vacation of a portion of Paul Avenue Northeast in the Fort Ward area~ and by
Ordinance No. 98-06, passed on January 5, 1998, the City Council approved the alteratioa of
certain lots irt Fo_rt Ward Estates, both to carry out and facilitate a plan to preserve the Fo~ Ward
parade gr~ands; ?.nil
WHEREAS, by Resolution No. 98431, the City Council further fixed a public hearing on
the proposed vaeatbn before the Public Workg Committee on January 26, 1998, at 4:30 p.m.; and
WHEREAS, the Public Works Committee held the hearing at the sdaedulext time, and
reported its recommendation to the City Council at the February 5, 1998 meeting of the City
Council; and
WHEREAS, the Cits' Council desires to vacate the right-of-way; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINOTON,
DO ORDAIN AS FOLLOWS:
Section 1. Upon execution by the mayor of the altered plat of Fort Ward Estates pursuant
to Ordinance No. 98-06, the portion of Paul Avenue Northeast in the Fort Ward area of the City
depicted on ExJaibit A shall be vacated. The width of the vacated po_~ion of Paul Avemae
Northeast abeming lots !%23 o2 ~x_b. ibit A shall be set forth in the altered plat,
Section .%. Upon execution of the altered plat as provided in Section 1 above, the Ci_ty
Clerk is authorized and directed tO file a certified copy of this ordinance wi~ the Kitsap County
Auditor.
~Sectioa 3. This Ordinance shall take effect and be in force five days from and after its
passage, approval and publication as requited by law.
PASSED by the City Council this 19 d~y of February, 1998.
