ORDINANCE NO. 98-02
AN ORDINANCE of the City of Bainbridge Island, Washington, authorizing
the vacation of a portion of an unnamed road off Baker Hill Road, a public
Right-Of-Way.
WHEREAS, a petition was submitted to vacate a portion of an unnamed road off Baker Hill
Road, the East 7.50 feet of that portion of the unnamed right-of-way lying adjacent to the West line of
Tract 29 of the Herrin & Rhodes Tracts as recorded in Volume 3, Page 111 of Plats, records of Kitsap
County, Washington, and situate in the Southwest quarter of Section 33, Township 25 North, Range 2
east, W.M., City of Bainbridge Island, Kitsap County, Washington; and
WHEREAS, the Public Works Department developed the required Certificate of Sufficiency
indicating that sufficient abutting property owners had signed the petition and queried other
utilities/governmental agencies as to public use; and
WHEREAS, the City Council approved Resolution No. 97-38 on 12-04-97, scheduling a Public
Hearing before the Public Works Committee on 1-19-98, which was rescheduled by Council approved
Resolution No. 97-45, on 12-18-97, to 1-26-98; and
WHEREAS the Public Works Committee held the required Public Hearing and does recommend
the vacation as requested;
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The petition to vacate a portion of an unnamed road off Baker Hill Road, more
fully described in Exhibit A, attached, is hereby approved.
Section 2. Pursuant to City ordinances, the petitioner(s) will obtain a property appraisal,
satisfactory to the City, and pay the fair market value for such property, prior to this vacation Ordinance
being formally approved, at which time the petitioner may have this vacation ordinance recorded with the
County.
