ORD 98-03 HIGH SCHOOL ROAD I ZONING DISTRICTORDINANCE NO. 98-03
AN ORDINANCE of the City of Bainbridge Island, Washington,
relating to the High School Road I zoning district and
formula take-out food restaurants; amending Uses Table,
Section 18.40.020 to add formula take-out restaurants
as a permitted use in the High School Road District I,
under certain conditions; repealing sections 18.06,360
and 18.06.865; and adding a new Section 18.41,050 to the
Design Guidelines of the Bainbridge Island Municipal Code.
WHEREAS, the City wishes to limit the location of Formula Take-out Food
restaurants in order to preserve the health, safety, and welfare of the
community; and
WHEREAS, those formula take-out food restaurants in existence or approved
for construction prior to the effective date of'this ordinance shall be allowed
to continue but must meet the requirements of the ordinance if the use is
discontinued for more than 180 days after the effective date of this ordinance;
and
WHEREAS, the City Council desires to clarify the district in which formula
take-out food restaurants are a permitted use; now, therefore
THE CITY COUNCIL OF THE CITY OF BAlMRIDGE ISLAND, WASHINGTON, DO ORDAIN,
as follows:
Section i. Section 18.40,020 of the Bainbridge Island Municipal Code, is
amended by adding the following use classification to the "Uses Table" and by
adding footnote number 7, as shown below:

7. Formula Take-out Food Restaurants may not exceed 4,000 square feet and may
not occupy more than 50 percent of any building in the zone in which they are
allowed. Only one formula take-out restaurant is permitted in any building. No
drive through windows are allowed.
Section 2. Section 18.41,050, Formula take-out restaurant Design
Guidelines, is hereby added as follows:
A.
1. There should be no exterior rending machines such as
soft drink dispensers, ice cube freezers, and the
like. Newspaper racks are acceptable if they are'
designed to be integrated with the design of the
structure.
2. Trash receptables shall be placed at the entrances to
any building containing formula take-out food
restaurants, and shall be maintained by those
businesses. Exterior receptacles shall not
exhibit logos, company colors/contours, or advertising.
B. The building and site design shall meet the Design
Guidelines established in 18.41.030 BIMC.
1. The activity shall be part of a larger complex of
activities such as continuous store front area, or existing
structure, or shopping center, and shall take its form
and design characteristics from the larger complex.
2. Outdoor storage areas, mechanical equipment, and
utility vaults, shall not be visible from adjacent
streets and pedestrian walkways.
3. Site services should be located on the least visible
side of a building or site or within interior building spaces.
4. All signs shall use natural materials such as wood,
metal, masonry or stone.
Section 3. Sections 18.06,360 and 18.06.865 of the BIMC are repealed.
Section 4. Section 18.06.370 of the Bainbridge Island Municipal Code is
amended as follows:
"Formula Take-Out Food restaurant" means a restaurant or establishment
that (1) is contractually required to offer standardized menus,
ingredients and interior or exterior design; and (2) which serves or
delivers its food or beverages in disposable containers.
Section 5. This ordinance shall take effect on and be in force five days
from and after its passage, approval and publication as required by law.
