ORD 98-07 AUTHORIZING VACATION OF PORTION OF ISLAND WAYReceived: 1/28/98; 01/28/98 4:58PM; 15:~4 425 635 7720 => BalnbT'idge ]:sland; #2 FAX 425 635 7720 INSLEE BEST -,-,-, BI ADMIN ~]002/004 ORDINANCE NO. 98-07 AN ORDINANCE of the City of Bainbridge Island, Washington, authorizing the vacation of a portion of Island Way abutting Lot 2 in the Record Plat of Tract 35 of the unrecorded plat of TrEmble according to Plat recorded in Volume $, page 17 of Plats, records of Kitsap County, Washington, together with that portion of Island Way as vacated by the Board of Kitsap County Commissioners on September 25, 1967. WHEREAS, Steven V. Gibbons and D. Denise Gibbons, the owners of Lot 2, Record Plat of Tract 35, of the unrecorded plat of Trimble, according to plat recorded in Volume 5 of Ham, page 17, in Kitsap County, Wastfington, together with that portion of Island Way as vacated by the Board of Kitsap County Commissioners on September 25, 1967, filed a petition with the City Council to vacate the portion of Island Way legally described on Exhibit A, attachext hereto and incorporated by this reference; and WHEREAS, by Resolution No. 93~10 adopted on March 18, 1993, the City Council set a public hearing on the petition before the Public Works Committee on April 19, 1993 at 5:30 p.m.; and WHEREAS, the Committee held the hearing at the scheduled time, and followin~l~ hearing, continued ~e hearing; and WHEREAS, by Resolution No. 94-31 adopted on August 18, 1994, the City Council set the continued public hearing on the petition before the Public Works Committee on September 26, 1994 at 7:00 p,m.; and WHEREAS, the Committee held ~xe coatinued hearing at the scheduled time, and following the hearing, submitted its report and recommendation to the City Council; and WHEREAS, the Gibbons proposed to transfer tho real property legally described on Exhibit B, attached hereto and incorporated by this reference, to the City for fight of way purposes in exchange for the vacation of the portion of Island Way, so that a portion of Island Way will simply be moved to the North; and WHEREAS, the City Council determined to vacate the portion of Island Way legally described on Exhibit A, and to accept the Gibbons' proposal to transfer the real property aescribea on Exhibit B in exchange for and as compensation for the vacation of the portion of Island Way; and DOC3\94700\001\0148597.01 01128/98 Rece.tved: 1/28/98; 4:58PM; 425 635 7720 => Bainbnidge island; ~,~ 01/28,,'98 15:55 FAX 425 635 7720 INSLEE BEST 44~ BI ADMIN 003/004 WHEREAS, the Gibbons have complied with the provisions of Chapter 12.34 of the Bainbridge Island Municipal Cocte, including transfer of the real property legally described on Exhibit B to the City as payment of the ftfil value of the portion of island Way to be vacated; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN as follows: Section.1. The portion of Island Way abutting Lot 2, Record Plat of Tract 35, of the uarecorde~ plat of Table, according to plat recorded in Volume 5 of Plats, page 17, in Kitsap County, Washington, together with that portion of Island Way as vacated by the Board of Kitsap County Commissioners on September 25, 1967, said portion of Island Way being legally described on Exhibit A, is vacated to Steven V. Gibbons and D. Denise Gibbons, husband and wife, the owners of such abutting property, subject to retention of the right of the City of Bainbridge Island to exercise anti grant easements for the construction, repair and maintenance of public utilities and services. S.e~tion 2. The City Council finds that the transfer to the City of me real property legally described on Ex~bit B will provide public access to the body of water known as Port Madison, comparable to the public access provided by Island Way prior to the vacation of the portion of lslanct Way.
