ORD 98-24 CONNECTION TO CITY WATERORDINANCE No. 98-24 AN ORDINANCE OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON RELATING TO CONNECTION TO THE CITY WATER SYSTEM, ADDING A NEW PARAGRAPH G TO BIMC 13.08.040, A NEW PARAGRAPH C TO BIMC 13.16.040, AND ADDING NEW SECTIONS E. 1.c AND E.5 .j TO ORDINANCE 82- 20, AS SUBSEQUENTLY AMENDED. WHEREAS, a structure for establishing water and sewer rates, charges and fees was put into place by Ordinance 82-20 and subsequently amended on numerous occasions; and WHEREAS, as a result of a professional study, the City restructured its water and sewer rates through Ordinance 97-09 and has also reviewed both its processes for charging for water and sewer service; and WHEREAS, as part of that review, the City changed its structure for charging water and sewer system participation fees through Ordinance 97-26 with the result that customers with larger water meters now pay significantly higher base water rates; and WHEREAS, those higher charges have caused a number of water and sewer customers to request smaller water meters and the City Council has determined that providing smaller meters is in the best interests of the public because they will encourage conservation; now therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. A new Paragraph G shall be added to Bainbridge Island Municipal Code 13.08.040 to read as follows: On and after March 1, 1999, each person applying to connect to the City' s water system or to change his or her use of the City' s water system shall provide a separate water meter for each separate category of use and for each separate building served, and, in order to allow the monitoring of consumption and to encourage water conservation, shall sub-meter each individual unit at his or her expense; provided, that this paragraph shall not apply to persons who submitted prior to October 1, 1998, a complete building permit application for the structure to be connected. SECTION 2. A new Paragraph C shall be added to Bainbridge Island Municipal Code 13.16.040 to read as follows: When an existing water and sewer customer who has paid the water and sewer system participation fees for service to a property requests in writing to replace a water meter serving the property with one of a smaller size, no system participation fee for either water or sewer shall be charged to change the meter size. A connection ("drop in") fee shall be charged as provided by resolution of the City Council to reimburse the City for the cost of the new water meter and fittings and of installing the new meter. SECTION 3. This Ordinance shall take effect and be in force on and after March 1, 1999. PASSED by the City Council this 4th day of February, 1999.
