ORD 98-38 AMENDING OFFICIAL ZONING MAPORDINANCE NO. 98-38
AN ORDINANCE of the City of Bainbridge Island,
Washington, amending the Official Zoning Map to correct
mapping errors on the Official Zoning Map.
WHEREAS, On August 1, 1991, by official action of the City council
through adoption of Ordinance 91-27, the zoning for Lot ~8 of the Madrona Park Heights
Plat, located at 612 Cherry Street (Thomas and Jacqueline Cain Rezone, File No. RZ03-25-
91-1 ) was changed from Single-family, R-2.9, to Single-family, R-3.5;
WHEREAS, The official Zoning Map of the City was not amended
according to the adopted Ordinance 91-27;
WHEREAS, On October 1, 1992, by official action of the City council
through adoption of Ordinance 92-27, the zoning for Lot 13 of the Madrona Park Heights
Plat located at 689 Park Avenue (Michael McCann Rezone, File No. RZ10-09-91-1) was
changed from Single-family, R-2.9, to Single-family, R-3.5;
WHEREAS, The official Zoning Map of the City was not amended
according to the adopted Ordinance 92-27;
WHEREAS, On April 4, 1996, by official action of the City Council
through adoption of Ordinance 96-08, the Mixed Use Town Center Zoning District with
five overlay districts including the Madison Avenue District was established and an area
map reflecting the new districts for the Town Center was adopted, amending the Official
Zoning Map. A Zoning Map for only the Mixed Use Town Center (MUTC) area was
attached to the Ordinance and became part of the Official Zoning Map for the City of
Bainbridge Island;
WHEREAS, On March 20, 1997 City Staff reproduced The Official Zoning
Map to incorporate City-wide amendments made to the Official Zoning Map as of March
20, 1997 and to include the amendments of the Mixed Use Town Center;
WHEREAS, At the time the Mixed Use Town Center zoning was
transferred to the Official Zoning Map dated March 20, a mapping error occurred on a
portion of the Madison Avenue Overlay District. The west side of Madison Avenue within
the Madison Avenue Overlay District is designated at a density of R-8. The mapping error
included this area in the R-14 density of the overlay district by omitting a line defining the
R-8 and R-14 density within the Madison Avenue Overlay District;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN, as follows:
Section 1. Lot 8 of the Madrona Park Heights Plat (tax parcels 4112-000-008-0108 and
4112-000-008-0207) shall be corrected on the Official Zoning Map to indicate R-3.5
Zoning as rezoned by Ordinance 91-27.
Section 2. Lot 13 of the Madrona Park Heights Plat (tax parcels 4112-000-013-0101
and 4112-000-013-0200) shall be corrected on the Official Zoning Map to indicate R-3.5
Zoning as rezoned by Ordinance 92-27.
Section 3. The west side of Madison Avenue within the Madison Avenue Overlay
District shall be corrected on the Official Zoning Map to indicate the density at R-8 as
established by Ordinance 96-08.
Section 4. This ordinance shall take effect on and be in force five days from and after its
passage, approval, and publication as required by law.
