RESOLUTION NO. 2024-09
A RESOLUTION of the City Council of Bainbridge Island,
Washington, declaring an emergency that requires suspension
of Procurement Policies for the repair of the Wastewater
Treatment Plant biosolids fine screen.
WHEREAS, the City’s Wastewater Treatment Plant (“WWTP”) operates a
biosolids fine screen to remove large materials from the process waste stream; and
WHEREAS, the biosolids captured by the fine screen meet Department of
Ecology class B standards for approved disposal methods under normal operation; and
WHEREAS, the fine screen is currently damaged and inoperable causing the
biosolids to be out of compliance with class B standards thus requiring alternative
disposal methods in an approved landfill; and
WHEREAS, disposal of waste solids into a landfill would only be authorized
temporarily by the Department of Ecology. The amount of waste that could be disposed
of would be at the discretion of a receiving landfill owner. Lacking a sufficient landfill
owner to accept the waste on a permanent basis, the amount of waste that can be disposed
of is small compared to the WWTP needs, thus constituting an emergency; and
WHEREAS, the WWTP will require emergency repairs to the biosolids fine
screen in order to meet the Department of Ecology's standards for class B biosolids in a
timely fashion; and
WHEREAS, the estimated cost of repairs is $40,000.00; and
WHEREAS, under RCW 39.04.280, Chapter 2.44 BIMC, and the City’s
Procurement Policy, the City Manager is authorized to proclaim and declare that an
emergency situation exists, waive competitive bidding requirements, and award all
necessary contracts on behalf of the City to address the emergency situation; and
WHEREAS, on June 24, 2024 the City Manager notified the City Council of the
existence of the emergency and of the City Manager’s written finding related to the
existence of the emergency related to the Wastewater Treatment Plant biosolids fine
screen repair.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS:
Section 1. The recitals set forth above are hereby adopted as findings of fact in
support of this proclamation and declaration of emergency related to the Wastewater
Treatment Plant biosolids fine screen repair.

Section 2. The City Council hereby ratifies and confirms the City Manager’s
declaration of emergency related to the Wastewater Treatment Plant biosolids fine screen
repair.
Section 3. The City Council hereby ratifies and confirms the emergency
procurement of services and work to respond to the Wastewater Treatment Plant
biosolids fine screen repair.
Section 4. The City Council hereby confirms the authority of the City Manager to
execute all agreements and obtain all permissions needed to respond to the emergency.
Section 5. This resolution shall take effect and be in force immediately upon its
passage.
Section 6. Severability. If any one or more sections, subsections, or sentences of
this resolution are held to be unconstitutional or invalid, such decision shall not affect the
validity of the remaining portion of this resolution and the same shall remain in full force
and effect.

SUBJECT: Emergency Procurement Required Related to the Operation of the Winslow Wastewater
Treatment Plant
DATE: June 24, 2024
This is to notify the Council, an emergency exists and pursuant to the Revised Code of Washington and the
City of Bainbridge Procurement Manual, competitive bidding requirements will be waived to address the
emergency.
The emergency exists due to malfunctions of certain portions of the Wastewater Treatment facility,
specifically the fine screens in the wastewater treatment process. Consequently, the regulatory agency the
Department of Ecology has determined our plant does not meet the standards of a class B facility. Unless
corrected, we must transport our biosolids to a landfill for disposal. Due to the amount of time it will take
to receive approval from a local health district, it is unlikely we will be allowed to transport biosolids.
We intend to retain the services of Treatment Equipment Company (TEC) to overhaul, replace, and
properly align the screen and install new hardware as required. Total contract price is $38,600. The work
will be completed within 3 — 5 days.
