ORDINANCE NO. 2024-22
AN ORDINANCE of the City of Bainbridge Island, Washington, adding BIMC
3.63.030.D and BIMC Figure 3.63.030-3 to designate the Finch Green properties
located at 7968 Finch Road NE as a Residential Targeted Area under the
Bainbridge Island Multifamily Tax Exemption (MFTE) Program.
WHEREAS, Washington state law authorizes the Bainbridge Island City Council to
adopt a Multifamily Tax Exemption (MFTE) program as described in Chapter 84.14 RCW, in
order to encourage the development and redevelopment of multifamily and affordable housing
by granting a property tax exemption; and
WHEREAS, on November 9, 2021, the City Council adopted Ordinance No. 2021-23,
establishing an MFTE program as Chapter 3.63 BIMC and designating the Winslow Subarea
Plan Area, the Winslow Sewer Service Area, and the Lynwood Center Neighborhood Center as
residential targeted areas in which multifamily and affordable housing development could
qualify for 12-year or 20-year exemptions from property taxes; and
WHEREAS, Bethany Lutheran Church is donating a portion of its land to develop Finch
Green, a permanently affordable housing project, in partnership with Housing Resources
Bainbridge; and
WHEREAS, the Finch Green properties are located outside the Winslow Sewer Service
Area and therefore not currently located in an MFTE residential targeted area, as described in
BIMC 3.63.030 and depicted on BIMC Figures 3.63.030-1 and 3.63.030-2; and
WHEREAS, on June 11, 2024, the City Council approved a motion to direct the City
Manager to initiate the process to amend the residential targeted areas eligible for the MFTE
program to include the Finch Green Properties; and
WHEREAS, on July 23, 2024, the City Council passed Resolution No. 2024-10 stating
its intention to consider the designation of the Finch Green properties as a residential targeted
area and setting a public hearing on such designation for August 13, 2024; and
WHEREAS, after holding the public hearing on August 13, 2024 and considering any
testimony received, the City Council determined to adopt this ordinance to designate the Finch
Green properties as an MFTE residential targeted area, as authorized by RCW 84.14.040(2).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Findings. The Bainbridge Island City Council finds that the Finch Green
properties located at 7968 Finch Road NE meet the criteria for designation as an MFTE
residential targeted area under RCW 84.14.040(1). Specifically:

A.The Finch Green properties are in an urban center, as defined in RCW
84.14.010(18).
B.The Finch Green properties are in an area that lacks sufficient available, desirable,
and convenient residential housing, including affordable housing, to meet the needs of the public
who would be likely to live in the urban center, if the affordable, desirable, attractive, and livable
places to live were available.
C.The providing of additional housing opportunity, including affordable housing, on
the Finch Green properties will assist in achieving one or more of the stated purposes of Chapter
84.14 RCW, including (1) encouraging increased residential opportunities, including affordable
housing opportunities, in the City of Bainbridge Island within urban centers where there are
currently insufficient housing opportunities, including affordable housing opportunities; and (2)
stimulating new construction of affordable multifamily units.
Section 2. Designation of Finch Green as a Residential Targeted Area. BIMC
3.63.030 is amended to designate the Finch Green properties at 7968 Finch Road NE as a
residential targeted area for purposes of the City’s MFTE program and to read as follows:
3.63.030 Designation of residential targeted areas.
Pursuant to RCW 84.14.040, the Bainbridge Island city council designates the
following areas as the targeted areas where the provisions of this chapter are
applicable, and as shown in Figures 3.63.030-1, and 3.63.030-2, and 3.63.030-3
below:
A.Winslow Master Plan Study Area.
B.Winslow Sewer Service Area.
C.Within the Lynwood Neighborhood Center Area, the Neighborhood Center
(NC), NC/R-12, and R-5 zones.
D.The Finch Green properties located at 7968 Finch Road NE.

Section 3. Severability. Should any section, paragraph, sentence, clause, or phrase of
this ordinance, or its application to any person or circumstance, be declared unconstitutional or
otherwise invalid for any reason, or should any portion of this ordinance be preempted by state
or federal law or regulation, such decision or preemption shall not affect the validity of the
remaining portions of this ordinance or its application to other persons or circumstances.
Section 4. Effective Date. This ordinance shall take effect and be in full force five (5)
days after its passage and publication as required by law.
