Ordinance No. 2024-26 Establishing Compensation for Presiding Pro Tem and Other Pro Tem Judges4863-1206-1649, v. 1 Page 1 of 2 {JEH4863-1206-1649;1/13023.000005/} ORDINANCE NO. 2024-26 AN ORDINANCE of the City of Bainbridge Island, Washington, establishing the compensation to be paid to the presiding pro tem judge and other pro tem judges of the Bainbridge Island Municipal Court. WHEREAS, RCW 3.50.090(1) provides that the compensation to be paid to pro tem judges of the municipal court must be fixed by ordinance of the municipality in which the court is located; and WHEREAS, BIMC 2.20.060.E provides for the compensation of the presiding pro tem judge and other pro tem judges of the Bainbridge Island Municipal Court to be set by separate ordinance, which shall not be codified; and WHEREAS, the current compensation paid to the presiding judge pro tem and other pro tem judges of the Bainbridge Island Municipal Court is $86.38 per hour; and WHEREAS, the Bainbridge Island Municipal Court Judge has recommended that the rate be increased to $100.00 per hour to be more consistent with the hourly rates for pro tem judges paid by other cities in Kitsap County; and WHEREAS, the Bainbridge Island City Council concurs with the Municipal Court Judge’s recommendation and has therefore decided to increase the compensation as recommended and to provide for future increases based on the Consumer Price Index for All Urban Consumers (CPI-U). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. Compensation of pro tem judges. The presiding judge pro tem and any other judges pro tem shall receive compensation at the rate of $100.00 per hour. Effective January 1, 2026 and every January 1 thereafter, the base rate of compensation in effect on December 31 of the immediately preceding year shall be increased by the amount of the June- June Seattle-Tacoma-Bellevue, All Items, CPI-U, for the most recent previous year, as is supplied by the United States Department of Labor, Bureau of Labor Statistics. Unless otherwise provided for by law, the presiding judge pro tem shall be compensated at the same rate as any other judge pro tem. Section 2. Severability. Should any section, paragraph, sentence, clause, or phrase of this ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this ordinance be preempted by state or federal law or regulation, such decision or preemption shall not affect the validity of the remaining portions of this ordinance or its application to other persons or circumstances. Section 3. Effective Date.
