Ordinance No. 2024-25 Amending 2.20.060.E - Municipal pro tem judge compensation4894-0247-6753, v. 1 Page 1 of 2 {JEH4894-0247-6753;1/13023.000005/} ORDINANCE NO. 2024-25 AN ORDINANCE of the City of Bainbridge Island, Washington, amending BIMC 2.20.060.E to provide for the compensation of the presiding judge pro tem and other pro tem judges of the Bainbridge Island Municipal Court to be set by separate ordinance. WHEREAS, RCW 3.50.090(1) provides that the compensation to be paid to pro tem judges of the municipal court must be fixed by ordinance of the municipality in which the court is located; and WHEREAS, BIMC 2.20.060.E provides for the compensation of the presiding pro tem judge and other pro tem judges of the Bainbridge Island Municipal Court at the rate of $75.00 per hour, plus an annual CPI-U increase, for a rate in 2024 of $86.38 per hour; and WHEREAS, the Bainbridge Island Municipal Court Judge has recommended that the rate be increased to $100.00 per hour to be more consistent with hourly rates for pro tem judges amounts paid by other cities in Kitsap County; and WHEREAS, the Bainbridge Island City Council concurs with the Municipal Court Judge’s recommendation and has therefore decided to increase the compensation as requested and to amend BIMC 2.20.060.E; and WHEREAS, the City Council has decided that the amount of the compensation does not need to be codified and has therefore determined to amend BIMC 2.20.060.E as provided in this ordinance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. Compensation of pro tem judges. BIMC 2.20.060.E is hereby amended to read as follows: E.The presiding judge pro tem and any other judges pro tem shall receive compensation at the a rate of $75.00 per hour. Effective January 1, 2023, the base rate of pay in effect on December 31, 2022, shall be increased by the amount of the June-June Seattle-Tacoma-Bellevue, All Items, CPI-U, for the most recent previous year, as is supplied by the United States Department of Labor, Bureau of Labor Statistics. Unless otherwise provided for by law, the presiding judge pro tem shall be compensated at the same rate as any other judge pro tem. set by separate ordinance of the city, which shall not be codified. Section 2. Severability. Should any section, paragraph, sentence, clause, or phrase of this ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this ordinance be preempted by state 4894-0247-6753, v. 1 Page 2 of 2 {JEH4894-0247-6753;1/13023.000005/} or federal law or regulation, such decision or preemption shall not affect the validity of the remaining portions of this ordinance or its application to other persons or circumstances. Section 3. Effective Date. This ordinance shall take effect and be in force five (5) days from its passage and publication as required by law.
