Resolution No. 2024-20 Proclaiming an Emergency Tree Removal to Facilitate Water Main Repair - Approved 121024Page 1 of 2 RESOLUTION NO. 2024-20 A RESOLUTION of the City of Bainbridge Island, Washington, declaring an emergency that requires suspension of Procurement Policies for the removal of a Douglas fir tree at risk of causing property damage or personal injury and also interfering with the repair of a water main break. WHEREAS, the City’s Public Works Operations and Maintenance Division was notified of a water main break on November 20, 2024 near Parfitt Way between Wood Avenue and Lovell Avenue; and WHEREAS, upon investigation of the water main break, City crews discovered that the cause was related to the main being impacted by tree roots from a large Douglas fir, which likely shifted during the “bomb cyclone” windstorm several days prior to the investigation; and WHEREAS, a temporary repair of the break was performed, but a permanent repair will require the removal of the subject tree; and WHEREAS, the tree roots are now compromised by the investigation of the water leak and therefore the tree poses a potential risk if not removed as soon as possible; and WHEREAS, the Public Works Department has identified a contractor that is available to remove the tree on December 2, 2024; and WHEREAS, removal of the tree requires the City’s contractor to partially access private property, and both of the impacted property owners have signed a temporary construction easement allowing property access; and WHEREAS, under BIMC 2.44.050, the City Council has designated the City Manager as the executive head of the City for purposes of emergency management; and WHEREAS, under BIMC 2.44.080, the City Manager is authorized to proclaim the existence or threatened existence of an emergency; and WHEREAS, under RCW 39.04.280, Chapter 2.44 BIMC, and the City’s Procurement Policy, the City Manager is authorized to proclaim and declare that an emergency situation exists, waive competitive bidding requirements, and award all necessary contracts on behalf of the City to address the emergency situation; and WHEREAS, on November 27, 2024, the City Manager notified the City Council of the existence of the emergency and of the City Manager’s written finding related to the existence of the emergency related to the tree removal. Page 2 of 2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS: Section 1. The recitals set forth above are hereby adopted as findings of fact in support of this proclamation and declaration of emergency related to the subject tree removal. Section 2. The City Council hereby ratifies and confirms the City Manager’s declaration of emergency related to the tree removal. Section 3. The City Council hereby ratifies and confirms the emergency procurement of services and work to respond to the tree removal. Section 4. The City Council hereby confirms the authority of the City Manager to execute all agreements and obtain all permissions needed to respond to the emergency. Section 5.
