Ordinance No. 2025-02 Affordable Housing Notch Property Purchase (Approved 011425)Page 1 of 2 ORDINANCE NO. 2025-02 AN ORDINANCE of the City of Bainbridge Island, Washington, amending the 2025-2026 biennial budget and providing for funding for the purchase of Kitsap County Parcel No. 262502-3- 101-2007 located at 180 Olympic Dr SE, and referred colloquially as the “Notch Property”. WHEREAS, on November 12, 2024, the City Council adopted the 2025-2026 biennial budget and 2023-2028 Capital Improvement Plan via Ordinance No. 2024-24; and WHEREAS, the City intends to purchase the Notch Property as part of its ongoing commitment to providing affordable housing; and WHEREAS, on August 13, 2024, the City Council provided via Ordinance No. 2024-19 for acquisition, including through the exercise of eminent domain, of land and real property rights for the purpose of constructing affordable housing; and authorized the City Manager to initiate eminent domain proceedings and to enter into agreements related to acquisition of the land and real property rights; specifying the method of payment for the land and real property rights; providing for severability; and establishing an effective date to move forward with the purchase of the Notch Property and to take all necessary action to effectuate and complete the transaction on behalf of the City of Bainbridge Island; and WHEREAS, the City commenced an eminent domain action to acquire the Notch Property in September 2024, and has reached a tentative settlement with the property owners which requires a budget amendment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. Ordinance No. 2025-02 and the 2025 budget are amended as shown on the attached Exhibit A (Crosswalk Summary by Fund), which is hereby incorporated fully into this ordinance. Section 2. The City’s Finance Director is authorized and directed by this ordinance to make the necessary changes to the 2025 budget. The Finance Director is further directed to make sufficient interfund equity transfers from the appropriate funds to cover the added amounts authorized by this ordinance. Section 3. Should any section, paragraph, sentence, clause, or phrase of this ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this ordinance be preempted by state or federal law or regulation, such decision or preemption shall not affect the Page 2 of 2 validity of the remaining portions of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect and be in force five (5) days from and after its passage and publication as required by law.
