Resolution No. 2025-07 Amending the Fee Schedule to Adopt Fees for Body-Worn Camera Video Redaction (Approved 042225)Page 1 of 2 RESOLUTION NO. 2025-07 A RESOLUTION of the City of Bainbridge Island, Washington, adding a fee for body-worn camera video redaction to the City’s Fee Schedule. WHEREAS, RCW 82.02.020 authorizes the collection of reasonable fees to cover the costs to the City for certain activities; and WHEREAS, the Bainbridge Island Police Department (“BIPD”) has implemented a body worn camera program that captures recordings that are public records subject to the Washington Public Records Act, Chapter 42.56 RCW (PRA). WHEREAS, the PRA exempts from release certain material in order to protect a person's right to privacy; and WHEREAS, the PRA allows a law enforcement agency to charge certain requesters the reasonable costs of redacting body worn camera videos prior to disclosure; and WHEREAS, the City of Bainbridge Island periodically updates the Fee Schedule to reflect City Council actions and the actual cost to the City of various services in accordance with state law. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. Section 3, Copy Fees, of the City’s Fee Schedule is amended to add the following new section: D. BODY-WORN CAMERA VIDEO REDACTION FEES Body-worn camera video redactions fees at the rate of $.90 per minute will be charged for the actual time it takes to redact a particular video. This includes targeted video redaction with or without targeted audio redaction, targeted audio redaction alone, or screen blur or screen blackout. Section 2. If any one or more sections, subsections, or sentences of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this Resolution and the same shall remain in full force and effect. Section 3. Should any section, paragraph, sentence, clause, or phrase of this resolution conflict with the terms of any prior ordinance or resolution, including terms related to fee or charge adjustments, the terms of this ordinance shall control.
