ORDINANCE NO. 2025-19
AN ORDINANCE of the City of Bainbridge Island, Washington, relating
to regulations of certain signs erected on property owned by the City of
Bainbridge Island; amending Section 15.08.115 of the Bainbridge Island
Municipal Code (BIMC).
WHEREAS, Ordinance No. 2024-27 repealed and replaced Chapter 15.08 of the
Bainbridge Island Municipal Code relating to signs; and
WHEREAS, Ordinance No. 2024-27 prohibited the erecting of sandwich board
signs on properties owned by the City of Bainbridge Island and public rights-of-way; and
WHEREAS, the municipal code as currently adopted prohibits farmers who lease
City-owned public farmland to place signs on their property advertising produce for sale;
and
WHEREAS, the City determined it is in the best interest of all parties to allow
businesses leasing City property to advertise on the land they have leased; and
WHEREAS, all other provisions of Chapter 15.08 continue to apply to
businesses leasing City property, including the need for a sandwich board sign permit to
display their sign on their leased property.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Section 15.08.115.B of the Bainbridge Island Municipal Code is
hereby amended to read as follows:
B.Sandwich board signs shall not be located within public rights-of way or
on public properties owned by the City of Bainbridge Island, except that
sandwich board signs may be located on City-owned properties by tenants
who are currently leasing such properties from the City, where the City
consents to such location, and all other requirements of this chapter are
met.
Section 2. Severability. Should any section, paragraph, sentence, clause, or
phrase of this ordinance, or its application to any person or circumstance, be declared
unconstitutional or otherwise invalid for any reason, or should any portion of this
ordinance be preempted by state or federal law or regulation, such decision or preemption
shall not affect the validity of the remaining portions of this ordinance or its application
to other persons or circumstances.
Section 3. This ordinance shall take effect and be in force five (5) days from its
passage and publication as required by law.
