A RE~OLUTION of the City of Winslow, ·.Washington,
accepting a sewer line extension along High
School Road- that has been constructed
conjunction with the Virginia Villa Project.
WHEREAS, by Resolution No. 89-48, adopted October 19, 1989,
the City Council approved the execution of a developer
extension- agreement between Blue Heron-Apartments, a. Limited
Partnership, and the City of Winslow for construction of a
sewer line extension along High school Road; and
WHEREAS, the sewer line constructed pursuant to the
developer extension agreement has been completed and the
developer has complied with the provisions of that agreement;
and
WHEREAS, the Public
recommended that'-,the
City of'Winslow; and
Maintenance Superintendent has
line extension be.accepted by the
WHEREAS,',.theI.-developer has filed with ..the City a
maintenance bond, a designation of contact person, and as-built
plans, as required by the developer extension agreement; now,
therefore,

RESOLVE AS FOLLOWS: .

sewers, ,.stubs~and appurtenances, described in the attachment to'
theWarranty Bill of Sale in Section 2 below. .~
Section 2. The City accepts the Warranty Bill of Sale
executed by Dujardin Development Company on August 28, 1990,
together with its Exhibit A and Attachment to Warranty Bill of
Sale, copies of which are attached hereto· and made a part
hereof.
Section 3 .... The City accepts 'the Grant =of Easement,'
executed by Kimiko R. Sakai, an individual, Kimiko R. Sakai and
J. Anthony Hoare, co-trustees of Sakai Qualified Terminable
Interest Property Trust and Sakai Family Trust, Isami Nakao and
Blue Heron Apartments, a Limited Partnership, and dated 17~

made a part hereof.

Section 4. The Mayor of the City is authorized to execute
the Storm Drainage System Maintenance Agreement and Declaration
of Covenents- Associated with Commercial/MUlt.iple Properties
Storm Drainage FaCilitieS, a copy of which is attached hereto
and.made a pa~t hereof. . ..........
-Section 5. The Mayor of the City is authorized to execute
the Notice of Sewer Facility Tap or Connection Charge
(RCW 65.08.170) and Delayed Benefit Charge (Winslow Municipal
Code 13.16.020), a copy of which_is a~tached. hereto and made a
part hereof.
Section 6. The City accepts the Easement for Drainage
System Access executed by Blue Heron Senior Apartments, a
Limited Partnership, a/k/a Virginia Villa, and Dujardin
Development Company and dated August 29, 1990, a copy of which
is-attached hereto-and made a part--hereof.I ....... ' .....
Section 7. The City Clerk-Treasurer is, directed and
authorized .to record with the. Kitsap County.Auditor the Grant
of~asement,,.the Storm Drainage System Maintenance Agreement.
and.- Declaration of Covenants Associated' with Commercial/
Multiple Property Storm..Drainage Facilities, the Notice of
Sewer Facility 'Tap or Connection Charge (RCW 65.08.170) and
