Resolution No. 2025-14 Wintergreen Townhomes Phase 2 Final SubdivisionPage 1 of 3 RESOLUTION NO. 2025-14 A RESOLUTION of the City Council of Bainbridge Island, Washington, approving the Wintergreen Townhomes Phase II Final Subdivision (City File No. PLN51836 F-SUB). WHEREAS, the final subdivision application for Wintergreen Townhomes Phase II creates 43 lots for development of townhome residential units on 1.32 acres of land located at 1329 Wintergreen Lane; and WHEREAS, on December 23, 2021, the Hearing Examiner entered a decision of approval with conditions for the preliminary subdivision application approving 73 lots on 2.95 acres of land located at 1329 and 1332 Wintergreen Lane in the High School Road-2 zone; and WHEREAS, on December 13, 2022, the City Council approved Resolution No. 2022-24, Wintergreen Townhomes Phase I, creating 30 lots for townhomes on 1.62 acres of land located at 1332 Wintergreen Lane; and WHEREAS, Phase I townhomes have been constructed, including and the applicant has been working on designing and permitting Phase II related roads, parking, and utilities; and WHEREAS, on November 7, 2024, the City Development Engineer issued a Grade / Fill Permit for construction of roads, parking, and utilities necessary for the subdivision (City File No. BLD26384A C-GAF), and subsequently approved permit revisions on January 10, June 26, and July 15, 2025; and WHEREAS, on July 7, 2025, the City Engineer completed review of the final subdivision and forwarded a recommendation for approval to the Department of Planning and Community Development; and WHEREAS, the City Development Engineer accepted a performance bond dated May 22, 2025 for the completion of facilities and infrastructure; and WHEREAS, on July 28, 2025, the City accepted an additional performance bond for the completion of the noise attenuation berm and fence, as approved by City File No. BLD26384A REV 2; and WHEREAS, the Bainbridge Island Fire Department has reviewed the Wintergreen Townhomes Phase II final subdivision application and on July 9, 2025, approved the final subdivision application; and WHEREAS, on July 28, 2025, the City accepted a landscaping performance bond related to landscaping to be planted within Phase II; and Page 2 of 3 WHEREAS, on July 28, 2025, the Department of Planning and Community Development issued its Compliance Notation Report and thereby evaluated compliance with the conditions imposed on the preliminary subdivision and other applicable ordinances and forwarded its recommendation for final subdivision approval to the City Council; and WHEREAS, on August 12, 2025, the City Council conducted a closed record proceeding regarding the Wintergreen Townhomes Phase II final subdivision. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS: Section 1. All conditions imposed by the approved preliminary subdivision for Phase II have been satisfied in the manner described in the Compliance Notation Report from the Department of Planning and Community Development. Section 2. The bonds and assurance devices submitted by the applicant adequately assure completion of all required plat improvements for Phase II. Section 3. The Wintergreen Townhomes Phase II final subdivision satisfies the requirements of state law, the Bainbridge Island Municipal Code, the City’s Comprehensive Plan, and all other applicable ordinances in effect at the time of preliminary plat approval. Section 4. The Mayor is authorized to inscribe the City Council’s approval on the face of the final plat; provided, that upon approval of the final plat, the Council may direct and authorize another member of the Council to inscribe the Council’s approval on the face of the final plat.
