RES 92-38 APPROVAL OF PRELIM PLAT MCLAUGHLAN HIGHLANDS (SUB01-30-90-1)RESOLUTION NUMBER 92-38 A RESOLUTION of the City of Bainbridge Island, Washington, approving the preliminary plat of McLaughlan Highlands on approximately .9 acres of real property bounded by Nakata Avenue on the west and Ihland Way on the north and in the vicinity of Madison Avenue to the east, upon application by Madison Avenue Partnership, represented by partners Bill Bechtold and Tom Hays (file #SUB01-30-90-1). WHEREAS, Madison Avenue Partnership submitted an application for approval of preliminary plat; and WHEREAS, the preliminary plat application is submitted to develop a plat of three single family lots on .9 acres of real property bounded by Nakata Avenue on the west and Ihland Way on the north and in the vicinity of Madison Avenue to the east (see Exhibit "A" -- legal description); and WHEREAS, the Bainbridge Island Planning Agency reviewed the preliminary plat application and recommended to the hearing examiner approval subject to eleven conditions; and WHEREAS, on July 22, 1992, the hearing examiner conduced a public hearing on the preliminary plat application upon proper notice; and WHEREAS, on August 3, 1992, the hearing examiner recommended conditional approval of the preliminary plat application, and entered a report, Findings of Fact, Conclusions of Law and Recommendations (see Exhibit "B"); and WHEREAS, on August 20, 1992, the Bainbridge Island City Council considered the recommendations of the hearing examiner and determined that it was in the public interest to adopt the Findings of Fact, Conclusions of Law and Recommendations of the Hearing Examiner, now therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: The Finding of Fact, Conclusions of Law and Recommendations of the hearing examiner (SUB01-30-90-1), as set forth in Exhibit "B", which is attached and incorporated by reference is adopted as the final decision of the Bainbridge Island City Council. Preliminary Plat Approval for McLaughlan Highlands, Res. #92- 38 Page 1 August 20, 1992 o The proposed subdivision is in conformity with the zoning ordinance (Ordinance #87-30), the comprehensive plan (Ordinance 87-29), the subdivision regulations (BIMC17.04) and subdivision standards (Ordinance 84-10), and all other applicable land use ordinances. , The application is approved subject to fulfillment of all conditions set forth in prior approvals of Short Plat #SPt03-22-90-1, recorded under Auditor's Number 9004200271. The final plat of McLaughlan Highlands shall state on its face that it is subject to the conditions of approval set forth in this resolution, as PASSED by the Council of the City of Bainbridge Island, Washington, this 20th day of August , 1992.
