92-08 WETLAND MAPPING AND THE GROWTH MANAGEMENT ACTResolution 92-08
A RESOLUTION of the City of Bainbridge Island, Washington,
recommending to the State of Washington that: 1) proposed bills dealing
with Wetlands Mapping and Regulation (SB6096, SB 6254, SSB 6255)
and Use of Real Estate Excise Taxes (SB6408) be opposed because they
would displace existing regulatory programs and disrupt the efforts by
the City of Bainbridge Island, now in the process of adopting wetlands
regulations and planning funding strategies, and 2) obligations to and
from local governments provided under the Growth Management Act be
maintained.
WHEREAS on June 271h, 1991, the 52nd Legislature of Washington State passed a bill
(ESHB1025) in special session to strengthen the landmark Growth Management Act (ESHB
2929) passed in July of 1990;
Whereas these bills together provide the necessary framework for counties and cities to produce
a comprehensive land use plan, and more specifically this Act requires counties and cities in
Washington to adopt development regulations to protect its critical areas using designated time
schedules and funding; and
Whereas critical areas include aquifer recharge areas, fish and wildlife habitats, wetlands and
streams, all of which have been defined at the time this Act was passed; and
Whereas Bainbridge Island has had three citizen committees, supported by hundreds of
volunteers, working to recommend various legislation to the City Council, including an
Environmentally Sensitive Areas Ordinance, and these citizen committees have coordinated their
efforts with consultants and the Bainbridge Island Department of Planning and Community
Development for more than one year; and
Whereas based on these efforts, the City of Bainbridge Island has adopted as law an
Environmentally Sensitive Areas Ordinance mandated by the Growth Management Act, and has
and will pass other laws which relate to this ordinance,
NOW THEREFORE BE IT RESOLVED THAT:
1. The Bainbridge Island City Council opposes wetland bills SB 6096, SB6254, and SSB 6255
because they would displace existing regulatory programs and undermine the efforts of citizen
and governmental groups now in the process of adopting wetland regulations.
2. The Bainbridge Island City Council opposes the bill restricting the use of real estate excise
taxes (SB 6408) since it would rescind current funding authority for cities needed to carry
out the Growth Management Act.
3. The Bainbridge Island City Council opposes any plans to eliminate needed technical
assistance by the Department of Ecology for wetlands programs.
4. The government of Bainbridge Island, with the help of its staff and its citizens, will continue
its commitment to the Growth Management Act as enacted in 1990 and 1991, as it considers
the results derived will be important to the community now and in the future.
