92-06 APPROVAL OF PRELIM PLAT OF WING POINT FAIRWAY VIEWRESOLgTION NO. 92-06
~ RESOLUTION of the City of Bainbridge Island,
Washington, approving the preliminary plat of
Wing Point Fairway View on approximately 21.6
acres of real property bounded by Grand Avenue
along the northeast, Dingley Road on the
south, and Wing Point Golf and Country Club,
Aaron Avenue and North Hill at Wing Point
subdivision to the west, upon application by
Triad Development, Inc.( File No. SUB 05-10-
90-1).
WHEREAS, Triad Development, inc. has submitted an application for
approval of a preliminary plat; and
WHEREAS, the preliminary plat application is submitted to develop
a plat of 47 single-family lots on 21.6 acres of real property
bounded by Grand Avenue along the northeast, Dingley Road on the
south, and Wing Point Golf and Country Club, Aaron Avenue and North
Hill at Wing Point subdivision to the west (See Exhibit "A" - Legal
Description); and
WHEREAS, the Planning Agency reviewed the preliminary plat
application and recommended to the Hearing Examiner approval
thereof, subject to a number of conditions; and
WHEREAS, on September 25, October 18 and December 9, 1991 the
Hearing Examiner held public hearings on the preliminary plat
application upon proper notice; and
WHEREAS, on December 11, 1991, the Hearing Examiner recommended
conditional approval of the preliminary plat application, and
entered a report, Findings of Fact, Conclusions of Law and
Recommendations (See Exhibit "B"); and
WHEREAS, on January 16, 1992, the City Council considered the
recommendations of the Hearing Examiner and determined that it was
in the public interest to adopt the Findings of Fact, Conclusions
of Law and Recommendations of the Hearing Examiner, as clarified;
now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES
RESOLVE AS FOLLOWS:
The Findings of Fact, Conclusions of Law and Recommendations
of the Hearing Examiner (SUB 05-10-90-1), as set forth in
Exhibit "B," which is attached and incorporated by reference
is adopted as the final decision of the City Council, and is
clarified as follows:
(a) The Hearing Examiner's alternative recommendation to
extend Dingley Road from Cherry Avenue to Park Avenue is
accepted and shall be funded by the developer;
(b) There shall be a comp].eteiy undisturbed 330 ft. core zone
for bald eagle protection, which shall be accomplished by
reconfiguring Lot 1 of Area B and Lots 6 and 7 of Area 4 and
removing the pedestrian path from the 330 ft. core;
(c) There shall be retained a separate unbuildable lot, the
area between the water tower and Cherry Avenue (as shown on
the preliminary plat approved by the Hearing Examiner); and
(d) Lot 47 shall not be located in the open space area (as the
applicant proposed to the Council).
The proposed subdivision is in conformity with the Zoning
Ordinance, the Comprehensive Plan, the Subdivision Regulations
and Standards, and all other applicable land use ordinances.
The proposed subdivision is consistent with Ordinance 79-16
(which approved the underlying PUD) -_.
The proposed subdivision shall comply with the conditions of
Ordinance No. 81-39 (See Exhibit "C") and Ordinance No. 89-33
(See Exhibit "D"), which address developer contributions to
sidewalk improvements along Cherry Avenue, Wing Point Way and
Ferncliff Avenue, to the extent applicable to Wing Point
FairWay View.
The application is approved, subject to fulfillment of all of
the conditions set forth in the Hearing Examiners's Findings
of Fact, Conclusions of Law and Recommendations, as clarified
in this resolution.
The final plat of Wing Point Fairway View shall state on its
face that it is subject to the conditions of approval set
forth in this resolution, as
PASSED by the Council of the City of Bainbridge Island, Washington,
this 20th day of Febru,]-~y , 1992.
