RES 95-29 PUBLIC PARTICIPATION IN COMP PLAN AMENDMENTSRESOLUTION NO. 95-29 A RESOLUTION of the City of Bainbridge Island, Washington, relating to establishing a public participation procedure for the preparation of a comprehensive plan amendment mandated by the remand of the Central Puget Sound Growth Management Hearings Board. WHEREAS, City of Bainbridge Island adopted a Comprehensive Plan on September 1, 1994; and WHEREAS, the City's adopted Comprehensive Plan was appealed to the Central Puget Sound Growth Management Hearings Board (Hearings Board); and WHEREAS, the Hearings Board held that the City's Comprehensive Plan is in compliance with the requirements of the Growth Management Act, except for three issues: The population allocation - The Plan is remanded to the City with instructions for the City to incorporate the May 1994 population allocation of 6,820 persons from the County or if the County makes a later population allocation, to incorporate that allocation as required by RCW 36.70A. 130. , The Capital Facilities Element of the Plan is remanded to the City for a more localized analysis of the public facilities infrastructure required to support the proposed growth for the Winslow urban core as required by RCW 36.70A.070(3)(b) and (c). "Overriding Principle #1" which states "preserve rural character of the Island" violates RCW 36.70A.020 (1) and (2) and is remanded to the City for removal of the word "rural"; and WHEREAS, the Hearings Board remanded the City's Plan to address those three issues by November 3, 1995; and WHEREAS, the City must amend the Comprehensive Plan to respond to the remand of the Hearings Board; and WHEREAS, pursuant to the Growth Management Act the City is to establish a public participation procedure to ensure early and continuous public participation; NOW, THEREFORE, be it resolved by the City Council of the City of Bainbridge Island, Washington, as follows: Section 1. The City Council hereby adopts a procedure for public participation in the development of the amendment to the Comprehensive Plan mandated by the Hearings Board, as set out in Attachment 1.
