RES 95-37 ADU PROCEDURAL REVIEWRESOLUTION NO. 95-37 A RESOLUTION of the City of Bainbridge Island, Washington, establishing procedures to review on an ongoing basis the number and use of accessory dwelling units and manufactured homes built subsequent to the passage of Ordinance 95-07 and the number of HUD-defined affordable houses built on nonconforming lots subsequent to the passage of Ordinance 95- 36 WHEREAS, the City is required to plan for affordable housing needs under the RCW 43,185 A; and WHEREAS, the City is committed to achieving the goals and policies of the recently adopted Comprehensive Plan (Ordinance 94-21); and WHEREAS, one of the Comprehensive Plan's five overriding principles states that preserving and promoting affordable housing on the Island is fundamental to achieving economic and social diversity among residents of the Island; and WHEREAS, Ordinance 95-07 relating to accessory dwelling units and manufactured homes and Ordinance 95-36 relating to development of HUD~defined affordable housing on nonconforming lots have the potential to increase affordable housing units for the rental housing market and for potential homeowners in both lower and middle income ranges and to disperse such housing inventory throughout all geographic areas of the Island; and WHEREAS, the carrying capacity of the Island is not known and as information on housing and on the Island's finite resources becomes available, it may be necessary to adjust implementation strategies and propose amendments which will more effectively achieve the affordable housing goals and policies of the Comprehensive Plan; NOW, THEREFORE BE IT RESOLVED, that: o The City of Bainbridge Island is committed to evaluating the effectiveness of the Comprehensive Plan's housing policies and programs. The City's Planning Department shall accordingly monitor and report to the Planning Commission and the City Council on an annual basis the development of all types of housing on the Island. 8/30195 resadu95-dk To enable such monitoring, reporting and evaluation, the City's Planning Department shall implement procedures to collect and maintain a record of information including, but not limited to,_the following: The number and location of accessory dwelling units and manufactured homes built subsequent to the passage of Ordinance 95-07. The use of accessory dwelling units at the time of the annual review. When property owners voluntarily provide "use" information, if "use" is as a rental, documenting the amount of rent charged is also encouraged. Page 1 of 2 c. The number of people who apply for exemptions under BIMC 15.28.070. The number and type of complaints received by the City which pertain to the impact of accessory dwelling units upon the neighborhood in which they are located. The number of permits issued for HUD-defined affordable housing built on non-conforming lots and other relevant information collected during the annual re-certification process including the income levels targeted. 4. The property owner shall be notified in writing, at the building permit stage, that information on the status of the accessory dwelling unit being permitted will be requested annually by the City's Planning Department, and that responding to such a request is voluntary on the part of the property owner.
