RES 96-34 APPROVAL OF DIVISION I OF FINAL PLAT OF HILLANDALEResolution No. 96-34
A Resolution of the City of Bainbridge Island, Washington,
approving Division 1 of the final plat of Hillandale (formerly
Weaver West), File No. SUB/PUD06-18-90-1 and
FSUB06-25-96-1.
WHEREAS, by Ordinance No. 93-28, adopted on August 5, 1993, the City Council
approved the preliminary plat and planned unit development of Hillandale (formerly Weaver
West), on approximately 13.9 acres of property located adjacent to Wyatt Way to the south and
Weaver Avenue NE to the west, upon the application of Connor Development Company and
Wyatt & Weaver Associates; and
WHEREAS, on June 25, 1996, Dick Allen submitted a final plat application to the
Department of Planning and Community Development; and
WHEREAS, the City Engineer reviewed the final plat and forwarded a recommendation
for approval to the Department; and
WHEREAS, the Department of Planning and Community Development reviewed the final
plat and forwarded its recommendation and the recommendations of other departments for
approval to the City Council; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Condition #25 is understood to require a combined total of front and rear yards
of 35 feet (40 feet along the 20 -foot vegetated perimeter). To provide flexibility for house
placement on each lot, the City Council will allow front yards to be reduced to 10 feet as long
as the combined total remains the same with exception to lots 16 & 17 which shall be allowed
to reduce the front yard by 5 feet before these provisions apply.
Section 2. The City Council finds that the subdivision proposed for final plat approval
conforms to all terms and conditions of approval for the planned unit development and
preliminary plat.
Section 3. The City Council finds that the subdivision proposed for final plat approval
and the final plat meet the requirements of Chapter 58.17 RCW, other applicable State laws,
BIMC Chapter 17.04, the zoning ordinance and all other applicable ordinances that were in
effect at the time of preliminary plat approval.
Section 4. The Mayor is authorized and directed to inscribe and execute the City
Council's approval on the face of the final plat.
Section 5. The City Clerk is authorized and directed to file the original of the final plat
for record with the Kitsap County Auditor, and to file one reproducible copy of the final plat
(containing the Kitsap County Auditor's recording number) with the City Clerk, the City
Engineer, the Kitsap County Assessor and the applicant.
