RES 96-17 APPROVAL OF PRELIMINARY PLAT OF KALLGREN GROVERESOLUTION NUMBER 96-17
A RESOLUTION of the City of Bainbridge Island,
Washington, approving the preliminary plat of Kallgren
Grove on approximately 4.76 acres of real property roughly
between Sunrise Road, Day Road, Winters Road and adjacent
to Kallgren Road, upon the application of the Kitsap County
Consolidated Housing Authority (file #SUB/PUD 07-21-95-1).
WHEREAS, the Kitsap County Consolidated Housing Authority submitted an
application for approval of preliminary plat; and
WHEREAS, the preliminary plat application is submitted to develop a plat of
five single family lots on 4.67 acres of real property roughly between Sunrise Road,
Day Road, Winters Road and adjacent to Kallgren Road; and
WHEREAS, the Bainbridge Island Planning Commission reviewed the
preliminary plat application and recommended conditioned approval to the hearing
examiner; and
WHEREAS, on February 22; 1996, the hearing examiner conducted a public
hearing on the preliminary plat application upon proper notice; and
WHEREAS, on February 29, 1996, the hearing examiner recommended
conditional approval of the preliminary plat application, and entered a report, Findings
of Fact, Conclusions of Law and Recommendations; and
WHEREAS, on April 4, 1996, the Bainbridge Island City Council considered
the recommendations of the hearing examiner and determined that it was in the public
interest to adopt the Findings of Fact, Conclusions of Law and Recommendations of
the Hearing Examiner, now therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES RESOLVE AS FOLLOWS:
Section 1. The Finding of Fact, Conclusions of Law and Recommendations of the
hearing examiner (SUB/PUD07-21-95-1) as set forth in Exhibit "A", which is attached
and incorporated by reference, is adopted as the final decision of the Bainbridge Island
City Council with the following added condition:
17. Prior to final plat approval the applicant shall provide language to the
City guaranteeing that upon sale of property to owners that are not

qualified as low income as defined in Chapter 15.28 of the Bainbridge
Island Municipal Code, the school impact fees will be recaptured to the
public entities.
Section 2. The proposed subdivision is in conformity with the zoning ordinance, the
comprehensive plan, the subdivision regulations and subdivision standards, and all
other applicable land use ordinances.
Section 3. The final plat of Kallgren Grove shall state on its face that it is subject to
the conditions of approval set forth in this resolution, as
PASSED by the Council of the City of Bainbridge Island, Washington, this 4th day of
April, 1996.
