RES 97-32 APPROVAL OF FERNBROOK SUBDIVISION PRELIMINARY PLAT (SUB06-12-97-1)RESOLUTION NO. 9%32 A RESOLUTION of the City of Bainbridge Island, Washington, approving the Fernbrook Subdivision pre 'luninary plat (SUB06-12-97-1). WHEREAS, on June 12, 1997, a preliminary plat application was submitted by Ras Property Development Co. to the DeparUnent of Planning and Community Development; and, WHEREAS, the preliminary plat application is submitted to develop a plat of 10 single family residential lots on three acres of real property south of Klickitat Avenue and on the west side of Ferncliff Avenue; and, WHEREAS, the Planning Department reviewed and forwarded its recommendation(s) for approval to the Hearing Examiner; and, WHEREAS, on September 19, 1997, the Hearing Examiner conducted a public hearing on the prelimina~ plat upon proper notice; and, WHEREAS, on October 6, 1997, the Hearing Examiner recommended conditional approval of the preliminary plat application and entered a report, Findings of Fact, Conclusions of Law and Recommendations; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The City Council upholds the October 6, 1997, Findings of Fact, Conclusions of Law and Recommendations of the Hearing Examiner for the proposed subdivision, (SUB06-12-97-1), except that Condition No. 5, is amended to read as follows: Fertilizers, herbicides, pesticides and irrigation of the law area shown as informal active recreation should be used at the minimum necessary for its maintenance and shall not exceed levels conforming with best management practices as defined by the Kitsap Conseveation District so as not to have an adverse effect on water quality. Section 2. The proposed subdivision is in conformity with the zoning ordinance, the comprehensive plan, the subdivision regulations and subdivision standards, and all other applicable land use ordinance and applicable state law in effect at the time of preliminary plat approval.. Section 3. The final plat of Fcmbrook shall state on its face that it is subject to the conditions of approval set forth in this resolution.
