RES 97-31 APPROVAL OF STETSON RIDGE PRELIMINARY PLAT (SUB8-96-1)RESOLUTION NO. 97-31 A RESOLUTION OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, APPROVING THE STETSON RIDGE DEVELOPMENT COMPANY'S PRELIMINARY PLAT REFERRED TO AS STETSON RIDGE (SUB084)6-96-1) WHEREAS, on August 8, 1996, a PUD application was submitted to the Department of Planning and Community Development; and WHEREAS, this application was withdrawn in December of 1996, and a new application for a 20-lot, flexible lot subdivision was submitted to the City of Bainbridge on March 17, 1997; and WHEREAS, on August 22, 1997, a public hearing on the preliminary subdivision was held before the Hearing Examiner; and WHEREAS, on September 16, 1997, the Hearing Examiner issued Findings of Fact, Conclusions of Law and Recommendations, recommending approval of the preliminary subdivision subject to conditions; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The City Council adopts the September 16, 1997, Findings of Fact, Conclusions of Law and Recommendations of the Hearing Examiner for the proposed subdivision, except that: 1) Finding of Fact No. 11, pg. 6, third sentence and Conclusion of Law No. 1, pg. 12, third sentence, are mended as follows: "Internal access will be provided by a proposed 12 foot wide one-way loop roadway, Haley Loop, which shall be a public road in a 30 foot public right-of-way". 2) Condition of approval No. 24, pg. 19, is amended as follows: "All utilities shall meet all applicable City of Bainbridge Island Public works Standards and the 12-foot wide, one-way loop roadway, Haley Loop, shall be a public road in a 30 foot public right-of-way". Section 2. The proposed subdivision is in conformity with the zoning ordinance, the comprehensive plan, the subdivision regulations and standards and all other applicable land use ordinances and applicable state law in effect at the time of preliminary plat approval. Section 3. conditions of approval of this resolution. PASSED by the City Council this 6~ day of November, 1997. APPROVED by the Mayor this 8~ day of November, 1997. The final plat of Stetson Ridge shall state on its face that it is subject to the ANDREW W. MARON, Mayor AT~ST/AUTHENTICATE: SUSAN P.
