A Resolution of the City of Bainbridge Island, Washington,
approving Division 2 of the f'mal plat of Hillandale (formerly
Weaver West), File No. SUB/PUD06-18-90-1 and
FSUB09-04-97-1.
WlqFREAS, by Ordinance No. 93-28, adopted on August 5, 1993~ the City Council
approved the preliminary plat and planned unit development of I-Iillandale (formerly Weaver West),
on approximately 13.9 acres of property located adjacent to Wyatt Way to the south and Weaver
Avenue NE to the west, upon the application of Connor Development Company and Wyatt &
Weaver Associates; and
WHEREAS, on September 4, 1997, Dick Allen submitted a final plat application to the
Department of Planning and Community Development; and
WHFREAS, the City Engineer reviewed the final plat and forwarded a recommendation for
approval to the Department; and
WHF. REAS, the Department of Planning and Community Development reviewed the final
plat and forwarded its recommendation and the recommendations of other departments for approval
to the City Council; now, therefore,
THE City Council OF THE City OF BAINBRIDGE ISLAND, WASHINGTON, DOES
RESOLVE AS FOLLOWS:
Section 1. Condition//25 is understood to require a combined total of front and rear yards
of 35 feet (40 feet along the 20-foot vegetated perimeter). To provide flexibility for house
placement on each lot, the City Council will allow front yards to be reduced to 10 feet as long as
the combined total remains the same, with the exception to Lots 23 & 24, and Lots 33 through 36,
which shall be allowed to reduce the front yard five feet before these provisions apply.
Section 2. Condition g'25 requires a 50-foot building setback from the eastern property line'
for Lots 21, 22 and 23. The applicant requests that the setback for LOt 21 be reduced to 40 feet for
construction of a 2-story home with a garage in the rear; the setback for LOt 22 be reduced to 45
feet only for construction of a one-story home with a garage in the rear; and the setback for Lot 23
be reduced to 40 feet for construction of a one-story home witha garage in the rear. All garages to
be built in the rear are understood to be one story with a pitch no greater than 8:12. The City
Council considers the applicant's requested modification as shown in.a drawing dated October 14,
1997, illustrating likely locations for the future homes and garages
to be minor and in accordance with BIMC17.04.115(C) and BIMC18.120.130(A), the City
Council grants this modification.
Section 3. The City Council finds that the subdivision proposed for final plat approval
conforms to all terms and conditions of approval for the planned unit development and preliminary
plat.
Section 4. The City Council finds that the subdivision proposed for final plat approval and
the final plat meet the requirements of Chapter 58.17 RCW, other applicable State laws, BIMC
Chapter 17.04, the zoning ordinance and all other applicable ordinances that were in effect at the
time of preliminary plat approval.
Section 5. The Mayor or Council Chair is authorized and directed to inscribe and execute
the City Council's approval on the face of the final plat.
Section 6. The City Clerk is authorized and directed to file the original of the final plat for
record with the Kitsap County Auditor, and to file one reproducible copy of the final plat
(containing the Kitsap County Auditor's recording number) with the City Clerk, the City Engineer,
the Kitsap County Assessor and the applicant.

Stanley Farrat and Brenda Bell have graciously agreed to grant me concessions
as outlined in this memo. The attached layout addresses the concessions for all
three lots.
On lot 21 we may increase the building envelope by 10 feet to the east and may
build a two story home with the garage behind.
Lot 22 may have the building envelope expanded to the east by 5 feet if we
agree to build a one story house with the garage iv~ ~ r-~4/t,,~.
On lot 23 we may expand the building envelope to east by 10 feet if we build a
one story home with {he garage in the rear.
All garages built in the rear will be one story and have roof pitches no greater
than 8 in 12.
Additionally the proposed CC&Rs will be amended to restrict the height of any
vegetation in the rear of lots 22 and 23 to 30 feet. It would stipulate that the
ewners would have to maintain the trees to conform to this condition.
There would be the reduction in the side yard of lot 23 as proposed by your
office to 15 feet.
