RES 97-06 APPROVAL OF THE FINAL PLAT PHASEI OF HIDDEN COVE ESTATES SUBDIVISION RESOLUTION NO. 97-06 A RESOLUTION OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, APPROVING THE FINAL PLAT FOR PHASE I OF HIDDEN COVE ESTATES SUBDIVISION APPLICATION (FSUB12-06-96-1). COPY., WHEREAS, by Ordinance No. 93-46, adopted on November 18, 1993, the City Council approved the preliminary plat and planned unit development of Hidden Cove Estates, on approximately 189 acres of property located south of Hidden Cove Road NE, west of Phelps Road NE, and east of State Route 305, upon the application of North Washington Associates Limited Partnership; and WHEREAS, the City Engineer reviewed the final plat and finds that the subdivision meets the requirements of Chapter 58.17.160 RCW and forwarded recommendation for approval to the Department; and WHEREAS, the health district reviewed the final plat and forwarded recommendation for approval to the Department; and WHEREAS, the Department of Planning and Community Development reviewed the final plat and forwarded its recommendation for approval to the City Council; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The City Council finds that the subdivision proposed for final plat approval conforms to all terms and conditions of the preliminary plat approval; provided that the applicant shall include a provision in the CC&R's requiring the Homeowner's Association to be responsible for routine maintenance and repairs of public trails in the subdivision and to be responsible for a percentage to be determined by the Council of the cost of reconstruction of public trails in the subdivision. The applicant shall present amended CC&R's containing language satisfactory to the City implementing this requirement to the City Council for approval within 30 days of the effective date of this resolution. The amended CC&R's shall include definitions of normal maintenance and repair and reconstruction. Section 2. The City Council finds that bonds and the assurance devices by their essential term assure completion of all required plat improvements. Section 3. The City Council finds that the subdivision proposed for final plat approval and the final plat meet the requirements of state law, BIMC Chapter 17.04, the comprehensive plan, and all other applicable ordinances in effect at the time of preliminary plat approval. Section 4. The Mayor is authorized and directed to inscribe and execute the City Council's approval on the face of the final plat. Section 5. The City Clerk is authorized and directed to file the original of the final plat for recordation with the Kitsap County Auditor, and to file one reproducible copy of the final plat (containing the Kitsap County Auditor's recording number) with the City Clerk, the City Engineer, the Kitsap County Assessor and the applicant.
