A RESOLUTION of the City of Bainbridge Island, WEliington, approv/ng
the North Town Woods preliminary plat (File #SUB01-13-98-1)
WHEREAS, on January 13, 1998 a preliminary plat application was submitted by Mr. James
Laughlin~ to the Department of Phnning and Community Development; and
WHEREAS, the preliminary pht application facilities the development of 70 residential lots on
27.28 acres of real property located h..i~.diately northeast of the intersection of Spattsman Club Road NE
and NE New Brooklyn Road; and
WHEREAS, the Depiatment of Planning and Community Development reviewed and forwarded
its reco,~.,endation for conditional a~p~oval of the application to the Hcarin~ Examiner; and
WHEREAS, on October 16 and December 18, 1998, the Hearing Examiner conducted a public
hearing on the preliminary plat and upon proper notice; and
WHEREAS, on January 8, 1999, the Hearing Examiner recommended conditional approval of the
preliminary plat and entered a repom, Findings of Fact, Conclusions of Law and Recommendations;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES RESOLVE AS FOLLOWS:
Section 1. The Findings of Fact, Conclusions of Law and Recommendations of the Hearing
Examiner (File #SUB01-13-98-1), as set forth in Exhibit "A", which is attached and incorporated by
reference, is adopted as the final decision of the Bainbrid~e Island City Coonc~ except that: 1) Section 21
of the Findh~ sh-all state as follows in the first sentence "Vehicular access to the siie will be off NE New
Brooklyn Road and Soo~i Club Road NE; 2} the first sentence of Section 22 of the Fiualn~,s ~hall be
eliinimical; 3) the first senumce of Section 6 of the Conclusions of Law shall be amended to state "access
will be off hE New Brooklyn and Svortsman Club Road hE"; 4) chanidni the oht mad to reflect a forty
(40~ foot riltht-of wav on Svommau Club Road hE.
Section 2. The proposed preliminary pht is in conformance with the zoning ordinance, the
comprehensive plan, the preliminary pht regulations and standards, and all applicable land use ordinances
and applicable state law in effect at the time of preYuRinary plat approval.
Section 3. The final plat of North Town Woods shall state on the face that it is subject to the
conditions of approval set forth in thin resolution.
