RES 2004-05 SUMMIT SUBDIVISION PRELIMINARY PLAT APPROVALRESOLUTION NO. 2004-05
A RESOLUTION of the City of Bainbridge Island, Washington, approving the
Summit Subdivision preliminary plat (File No. SUB 1120 1)
WHEREAS, on June 6, 2001, a preliminary plat application was submitted by John Green
to the Department of Planning and Community Development; and
WHEREAS, the preliminary plat application facilitates creation of 25 residential lots with
open space on a 62 -acre parcel located east of Fort Ward Hill Road and south of Country Club
Road; and
WHEREAS, the Department of Planning and Community Development reviewed and
forwarded its recommendation for conditional approval to the Hearing Examiner; and
WHEREAS, on June 30th and July 18th, 2003, the Hearing Examiner conducted a public
hearing on the preliminary plat upon proper notice; and
WHEREAS, on October 14, 2003, the Hearing Examiner recommended conditional
approval of the preliminary plat and entered her Findings of Fact, Conclusions of Law, and
Recommendation; and
WHEREAS, on November 12, November 21, December 4, and December 11, 2003, the
City Council considered the Hearing Examiners recommendation and the record and determined
that the matter should be referred back to the Hearing Examiner;
WHEREAS, on February 12, 2004, the Hearing Examiner conducted a public hearing on
the remanded issues upon proper notice; and
WHEREAS, on February 26, 2004, the Hearing Examiner recommended approval of the
preliminary plat subject to the conditions stated in the Hearing Examiner's Decision and
Recommendation of October 14, 2003 as modified with additional conditions and changes
contained in the Supplemental Findings, Conclusions, and Recommendation on Remand dated
February 26, 2004; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DOES RESOLVE AS FOLLOWS:
Section 1. The Findings of Fact, Conclusions of Law and Recommendations of the
Hearing Examiner (File No. SUB 11201), as set forth in Exhibit "A" as modified by the
Supplemental Findings, Conclusions, and Recommendation on Remand, as set forth in Exhibit

"B" which are attached and incorporated by reference, are adopted as the final decision of the
Bainbridge Island City Council.
Section 2. The proposed preliminary plat is in conformance with the zoning ordinance,
the comprehensive plan, the subdivision regulations and standards, and all applicable land use
ordinances and applicable state law in effect at the time the fully completed application for
preliminary plat approval was submitted by John Green to the Department of Planning and
Community Development.
Section 3. The final plat of the Summit Subdivision shall state on its face that it is
subject to the conditions of approval set forth in this resolution.
PASSED by the Council of the City of Bainbridge Island, Washington, this 10th day of March,
2004.
