Resolution No. 2025-19 Relating to Revision of Certain City Fees (Approved 120925)Page 1 of 2 RESOLUTION NO. 2025-19 A RESOLUTION of the City of Bainbridge Island, Washington, updating certain fees in the City’s Fee Schedule. WHEREAS, RCW 82.02.020 authorizes the collection of reasonable fees to cover the costs to the City for certain activities; and WHEREAS, the City of Bainbridge Island periodically updates the Fee Schedule to reflect City Council actions and the actual cost to the City of various services in accordance with state law; and WHEREAS, on March 22, 2022, the City Council enacted Ordinance No. 2022-05 relating to the process of updating certain fees and charges, amending and retitling BIMC 15.04.050, expressly authorizing the City Council to update fees and charges by resolution, and providing for an annual adjustment of all City fees based on the U.S. Consumer Price Index (“CPI”); and WHEREAS, Section 4 of Ordinance No. 2022-05 and as amended via Ordinance No. 2022-15 specifies that all fees or charges levied by the City shall be subject to adjustment each year equal to the annual percentage increase in the United States Consumer Price Index, Seattle area (CIP-U), for June of the preceding year as shown in the release from the Bureau of Labor Statistics; except as specified in BIMC 15.30.140 for transportation impact fees, unless the City Council determines by December 31st of any year that the adjustment shall be another amount or shall not occur for the next year; and WHEREAS, on June 10, 2025, the City Council enacted Resolution No. 2025-12 updating certain Water and Sewer Utility fees in the City’s Fee Schedule including for the years 2026 through 2028; and WHEREAS, additional exceptions to the annual CPI-U adjustment apply to categories of fees that are set or limited by state law, established as fixed deposits, determined by external agencies, or adopted by separate Council resolutions, including but not limited to: (1) public- records fees determined by WAC and RCW; (2) clerk-certification fees; (3) park-use deposits set at a fixed amount; (4) surety deposits based on valuation of the project; (5) firearms-permit fees set by state law; (6) room-rental deposits; (7) exempt-well permit fees mandated by the Washington State Department of Health; and (8) boat-dock moorage fees established by Resolution No. 2025-03 and other Council actions. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The fee changes identified in Exhibit A of this Resolution, attached hereto and incorporated by reference, shall take effect January 1, 2026. Page 2 of 2 Section 2. Severability. If any one or more sections, subsections, or sentences of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this Resolution and the same shall remain in full force and effect. Section 3. Should any section, paragraph, sentence, clause, or phrase of this resolution conflict with the terms of any prior ordinance or resolution, including terms related to fee or charge adjustments, the terms of this ordinance shall control. Each water meter shall constitute one unit for the purposes of this rate schedule. Ordinance 98-24 provides that there shall be no new connections in this category after October 1, 1998.
