RES 2005-20 LAW & JUSTICE SALES TAX BALLOT MEASURERESOLUTION 2005-20
A RESOLUTION of the City of Bainbridge Island, Washington,
establishing a directive for the use of sales tax funds collected by
the passage of the Law and Justice Sales Tax Ballot Measure.
WHEREAS, the Washington state legislature in 2003 recognized and found that local
governments in the State of Washington face enormous challenges in the area of criminal justice
and public safety, and enacted RCW 82.14.450 for the purpose of allowing general local
governments to raise revenue in order to better protect the health and safety of Washington state
and its residents; and
WHEREAS, the Board of County Commissioners, as the legislative authority for Kitsap
County, intends to approve a resolution submitting to county voters a ballot measure authorizing
imposition of a sales tax and use tax of .15 percent, and, if authorized by the voters, to enact an
ordinance imposing such a tax; and
WHEREAS, if the voters approve the Law and Justice Sales Tax Ballot Measure, the
City of Bainbridge Island will receive its per capita share conservatively estimated to be
approximately $462,000 the first year•, and
WHEREAS, the City of Bainbridge Island desires to spend any such tax in accordance
with state law (RCW 82.14.450) and the wishes of the voting public.
NOW, THEREFORE, be it resolved by the City Council of the City of Bainbridge
Island, Washington:
Section 1. In accordance with state law, the revenue collected from this ballot measure
will not be used to supplant existing services already provided by the City of Bainbridge Island
and its police department.
Section 2. The tax revenue collected from the passage of this sales tax ballot measure
shall be used to enhance law enforcement services within the City of Bainbridge Island.
Specifically, the revenue shall be utilized to address: safety for our citizens and employees at
our court house, prevention and investigation of identity theft, domestic violence, sexual assault,
Child abuse and victimization of vulnerable adults, safety for our students and faculty at our
schools, and enhance traffic safety on the Island through education and enforcement. These
goals will be accomplished through cooperation with the Bainbridge Island Municipal Court,
Bainbridge Island Health Housing Human Services, Bainbridge Island School District, and the
City of Bainbridge Island Public Works Department.
If sales tax revenue from the approval of this measure exceeds expectations, any additional funds
shall be used in accordance with the goals listed in the above paragraph.

Section 3. In order to meet the desires of the voting public who voted and approved
such sales tax measure for the purpose of enhancing public safety, the sales tax revenue shall not
be used for any purpose other than as listed in Section 2 above.
Section 4. Severability. If any one or more sections, subsections, or sentences of this
Resolution are held to be unconstitutional or invalid, such decision shall not effect the validity of
the remaining portion of this Resolution and the same shall remain in full force and effect.
