AN ORDINANCE OF THE CITY OF WINSLOW PROVIDING
FOR TIIE REGULATION OF THE STOPPING AND
PARKING OF VEHICLES WITHIN THE CITY OF
WINSLOW AND REPEALING ORDINANCES 81-01,
81-03, 81-21, 81-25.

Section I
Regulations Applicable to Designated Parking Areas in
the City of Winslow

The following regulations regarding the stopping, standing
and parking of vehicles shall apply to the areas described below:
a. In areas designated "Back in Only," vehicles must be
16 backed into available parking places.
b. In areas designated "Loading Zone," no vehicle shall
stop, stand or be parked for any purpose or period of time other
than for the expeditious loading or unloading of passengers
during a period not to exceed three (3) minutes.
c. In areas designated "Disabled Loading," no vehicle
shall stop, stand or be parked for any purpose or period of time
23 other than for the expeditious loading or unloading of disabled
24 passengers during a reasonable period of time.
25 d. In areas designated "Disabled Parking Only," no vehicle
26 shall be parked unless it bears the decal or other official mark
27 of the State of Washington identifying the vehicle as one driven
28 by or otherwise used for the transportation of a disabled person
29 and unless the vehicle complies with all other parking
30 regulations set forth in this ordinance including the payment of
31 necessary parking fees.

e. In areas designated "No Parking," the parking of any

vehicle is prohibited.
f. In areas designated "Restricted Carpool," no vehicle
shall be parked before 9:00 A.M. on Monday through Friday,
unless:

1. A valid carpool permit issued by the City of
Winslow is displayed on the inside lower left-hand corner of
the windshield in such a manner that the carpool permit

number is visible from the outside of the vehicle;

2. The car is parked in the space assigned to the
11
carpool permit, and;
3. Three or more individuals are in the car at the
13
time it is parked in the assigned space.

4. If the carpool is reduced to less than three
15
individuals the car shall be parked in a non-carpool space
16
and pay the appropriate parking fee for that non-carpool
17
space.

g. In the area designated "Monthly Parking," no vehicle
19
shall be parked before 9:00 A.M. on Monday through Friday unless
a current, valid monthly parking permit issued by the City of
~qinslow is displayed on the inside lower left hand corner of the
windshield in such a manner that the monthly parking permit
number is visible from the outside of the vehicle.
At all other times during which these parking regulations
are in force, no vehicle may park in these "Carpool" or "Monthly

Parking" spaces unless there has been deposited in the applicable
parking fee collection box, in the appropriate slot, in United
States Currency, or by parking token issued by the City, the
appropriate parking fee designated by this Ordinance.

, h. In areas designated "No Parking 4:30 - 6:30 P.M.," no

vehicles shall be parked during the period 4:30 P. M. to 6:30

i. In areas for which a sign has been posted limiting the
hours during which parking is permitted or limiting the duration
of time during which cars may park, no vehicles shall be parked
for a longer period than the stated duration, provided, however,
that motorists wishing to park two or more consecutive 24-hour
periods on City streets near the Washington State Ferry Terminal
may do so only after making prior arrangements with the City of
~inslow for payment of all applicable parking fees, and provided
further that no vehicle may remain in the same numbered space for
more than three consecutive 24-hour periods. Failure to comply
with this regulation shall constitute "Overtime Parking."
j. In areas in which parking fee collection boxes have
been installed, no vehicle shall be parked during the hours for
which parking fees are charged unless there has been deposited in
15~the applicable parking fee collection box, in the appropriate
16!slot, in United States currency, or parking token issued by the
17 City the appropriate parking fee as designated in this
18i!Ordinance.

For purposes of vehicles parked on City street near the
20 Washington State Ferry Terminal, the parking fee collection boxes
21 shall be located at the foot of the hill in each designated
22 parking zone and shall be deemed the applicable parking fee
23 collection box.
For purposes of those vehicles parked in the Municipal
25
Parking Lot, the parking fee collection box located at the
26
southern end of the parking lot shall be deemed the applicable
27
parking fee collection box.

For purposes of those vehicles parked on Bjune and Brien
29
Drives, the parking fee collection box located at the east
30
intersection of Bjune Drive and Brien Drives shall be deemed to
iibe the applicable parking fee collection box.

Failure to comply with this regulation shall constitute
"Overtime Parking."
k. In areas designated "Taxi Zone," no vehicle other than
a taxi shall stop, stand or be parked for any purpose or period
of time. Taxis may stop, stand, or park in these areas solely
for the expeditious loading and unloading of passengers.

~i 1. In areas designated "Bus Zone," no vehicle other than a
8!] bus shall stop, stand or be parked for any purpose or period of
9ii time. Buses may stop, stand, or park in these areas solely for
10 the expeditious loading and unloading of passengers.

For purposes of this section, the term bus shall mean:

(1) any motor vehicle used for the purpose of carrying
passengers together with incidental baggage or freight or
either, on a regular schedule of time and rates; or
(2) any motor vehicle designed for the purpose of
carrying passengers (having a seating capacity for eleven or
more persons) used regularly to transport persons in
furtherance of any organized agricultural, religious, or
charitable purpose; or
(3) any school bus.
m. In areas designated "Bicycle Parking," only bicycles
shall be permitted to stop, stand or park in such areas. For
purposes of this section, "bicycle" means any device capable of
being propelled solely by human power upon which any person may
ride, having two tandem wheels either of which is more than
twenty inches in diameter.
n. In areas designated "Motorcycle Parking," only
motorcycles and mopeds shall stop, stand or park in such area.
For purposes of this section, "Motorcycle" means every motor
vehicle having a saddle for the use of the ride and designed to

1 travel on not more than three wheels in contact with the ground,
2 but excluding a farm tractor and a moped. For purposes of this
section, "Moped" means any two-wheeled or three-wheeled device
4 having fully operative pedals for propulsion by human power and a
5 motor with a cylinder displacement not exceeding fifty cubic
6 centimeters which produces no more than two gross brake
horsepower (developed by a prime mover, as measured by a brake
8 applied to the driving shaft) and is capable of propelling the
9 device at a maximum speed of not more than thirty miles per hour
10 on level ground, and the wheels of which are at least sixteen
11 inches in diameter.
Failure to comply with the regulations k-n shall constitute
13 "Illegal Parking."

15 II. REGULATIONS APPLICABLE TO STOPPING AND PARKING IN ALL AREAS
16~ OF THE CITY OF ~INSLOW
17~ 1. No vehicle shall stop, stand or park in such a manner as
18 to impede traffic. Impede traffic shall be defined as the
19 stopping, standing or parking of a vehicle in such a manner as to
~0i~interfere with, obstruct or stop the lawful passage of
~1 !pedestrians or other vehicles.
2. No vehicle shall stop, stand or park in any parking area
~3 designated by lines or marks in any manner that the vehicle
34 extends over or across any such line or mark or in such manner
25 that the vehicle is not within the area so designated by such
26~lines or marks. Failure to comply with this regulation shall
27 constitute "Improper Parking."
3. No vehicle shall stop, stand or park in any designated
29 or undesignated parking space in such a manner that the vehicle
30 faces on-coming traffic. Failure to comply with this regulation
31 shall constitute "Wrong Way" parking.

4. No vehicle shall stop, stand or park on any City owned
property except in areas which have been clearly identified by
the City by sign, painted lines or other marking as parking
spaces.

III. ADDITIONAL GENERAL REGULATIONS
a. No person shall deposit or cause to be deposited in any
parking fee collection box any slug, button, foreign currency,
money order or any other device or substance as a substitute for
currency of the United States or parking token issued by the
City. Failure to comply with this regulation shall constitute
"Illegal Use," and any items so deposited will not be credited
toward payment of the applicable parking fee.
b. No person shall duplicate or falsify any carpool parking
permit or monthly parking permit issued by the City of Winslow.
c. Compliance with the provisions of this ordinance shall
not relieve any person from compliance with the provisions of any
other Winslow Ordinances prohibiting or regulating the stopping,
standing or parking of vehicles.
ADMINISTRATION
a. The City of Winslow shall set up administrative
23~procedures for the administration of parking pursuant to the
24~iprovisions of this Ordinance, including, but not limited to,
25iprocedures for the issuance of carpool and monthly parking
26 !permits.
27L b. In addition, the Mayor shall appoint and swear in one or
28 more persons as parking enforcement officers who shall be under
29 !the supervision of the Police Department. The parking
30 enforcement officers shall have authority to issue notices of
31 :pedestrian infractions and traffic infractions relating to the

parking, standing or stopping of vehicles, but shall not be
considered Uniformed Police Officers for purposes of LEOFF and
Civil Service Statutes.
V. PARKING FEES
a. The following parking fees shall apply to parking within
the designated areas of the City of Winslow during the times set
forth below.

Fees and Hours Applicable to Parking in the Numbered Parking
Spaces Near the Washington State Ferry Terminal
Spaces 501-541:
(1) 6:00am - 9:00am - Limited to "Carpool" designated
automobiles parking during these hours in their
assigned spaces. Carpool automobiles may park all
day Monday through Friday for the sum of $35.00
each two calendar month period (not to be
pro-rated).
(2) 9:00am - 6:00pm - Available to all automobiles.
$2.00 per vehicle per incident of parking per day.
Spaces 542-629 and 669-685:
(1) 6:00am - 6:00pm.
(2) $2.00 per vehicle per incident of parking per day.
Spaces 630-668:
(1) 6:00am - 4:30pm.
(2) Commuter pick-up zone 4:30-6:30pm.
(3) $2.00 per vehicle per incident of parking per day.

Spaces in the Municipal Parking Lot Adjoining the Winslow

All Spaces:
(1) 6:00am - 9:00am - Limited to "Monthly" designated
automobiles parking during these hours.
Automobiles displaying current, valid monthly
permits may park all day Monday through Saturday
for the sum of $26.00 for each calendar month (not
to be pro-rated).
(2) 9:00am - 6:00pm - Available to all automobiles.
$1.00 per vehicle per incident of parking per day.
Fees and Hours Applicable to Parking in the Numbered Parking
Spaces on Brien and Bjune Drive
All Spaces:
(1) 6:00am - 6:00pm.
(2) $1.00 per vehicle per incident of parking per day.
b. No Hourly Rates
The fee of $1.00/$2.00 per vehicle per incident of
parking per day is a flat rate. No provision is made for hourly
rates.
Parking Tokens
$1.00 parking tokens shall be issued by the City in
27 lots of 10 tokens minimum. Tokens shall be sold at City Hall for
28 a 10% discount at the rate of $0.90 per token. Tokens shall be
29 nonrefundable.

d. Incident of Parking Defined
Incident of parking means 'the single act of parking a
single automobile in a single space within the parking area. The

$2.00 and $1.00 parking fees set forth above entitle to the payor
to a single incident of parking. The payor may not substitute
vehicles within a given space, may not leave and return to a
given space, and may not move to another space within the parking
area unless he pays an additional full day's parking fee for each
such change.

No Charge for Parking During Certain Hours
No fee shall be charged for parking a vehicle on City
1. On Sundays;
2. On legal holidays;
3. After 6:00 pm;
4. Before 6:00am.
PENALTIES
a. It shall be a traffic infraction for any person to
permit or allow a motor vehicle to stop, stand or to be parked in
violation of any of the provisions of this Ordinance. The
monetary penalty for violation of any of the provisions of this
Ordinance shall be $10.00 for each such violation. Notice of
traffic infractions shall be affixed in a conspicuous place to
the motor vehicle stopped, standing, or parking in violation of
the provisions of this Ordinance and shall be in the form
approved by the Administrator for the Courts. All monetary
penalties shall be paid to the Municipal Court of the City of
Winslow.
b. The procedures governing cases alleging a parking,
standing or stopping traffic infraction pursuant to this
ordinance shall be as prescribed by the Washington Supreme Court
in its Justice Court Traffic Infraction Rules, (hereinafter
JTIR).

c. In the event that response to the Notice of Traffic
Infraction is not made in accordance with the provisions of
paragraph VI. b. above, the following additional sanctions will
apply.
1.
An additional monetary penalty will be imposed
pursuant to JTIR 2.5 for failure to respond.
The City of ~inslow may refer the case to the City
Attorney for criminal prosecution.
VII. REVOCATION OF CARPOOL PERMITS
a. The City of Winslow shall revoke the carpool parking
privileges of any carpool parking permit holder determined to
have duplicated or falsified a carpool parking permit.
b. The City of Winslow shall revoke for a period of one
year the carpool parking privileges of any carpool parking permit
holder who is determined to have violated the provisions of
Section I.f. above on two or more occasions.
c. If, as a result of the revocations described in
paragraphs VII. a. and VII. b. above, the number of members in a
carpool group falls below three, the carpool group will be
responsible for substituting a new carpool member. This new
carpool member must be registered in the manner required by the
City of Winslow prior to the further exercise by the carpool
group members of their carpool permit privileges.
VIII. REVOCATION OF MONTHLY PARKING PERMITS
a. The City of Winslow shall revoke the monthly parking
privileges of any permit holder determined to have duplicated or
falsified a monthly parking permit.
b. The City of Winslow shall revoke for a period of one
year the monthly parking privileges of any permit holder who is

determined to have violated the provisions of Section I. g. above
on two or more occasions.
IX. REGISTERED OWNER'S RESPONSIBILITY
The registration or licensing of a vehicle in the name of a
person, persons, entity or entities shall raise a prima facie
presumption that the person, persons, entity or entities is
responsible for all traffic infractions set forth in this
ordinance which are attributable to the vehicle. The prima facie
presumption may be rebutted by a showing by the party or parties
charged with the traffic infraction that they are not in fact
responsible for the traffic infractions.
X. REPEALER
Winslow Ordinances 81-01, 81-03, 81-21, 81-25 are hereby
repealed.
XI. SEVERABILITY
Should any provisions of this ordinance be held invalid, the
remaining provisions of this ordinance shall continue in full
force and effect.
XII. EFFECTIVE DATE
This ordinance shall be in full force and effect five (5)
days after posting in the manner provided by law.
PASSED by the City Council of the City of Winslow and
approved by the Mayor on this 6th day of May , 1982.
