AN ORDINANCE AMENDING ORDINANCE 74-5 ADOPTED APRIL 1,
1974 AND PROVIDING FOR THE ACQUISITION AND TAKING
OF FEE TITLE OF CERTAIN PARCELS OF REAL PROPERTY
FOR THE PURPOSE OF ESTABLISHING A PUBLIC PARK.
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION 1.
Section 1 of Ordinance 74-5 adooted April 1, 1974, is
hereby deemed amended to correct the legal description shown
therein of the real Droperty to be taken as follows:
Parcel II: Bed of Eagle Harbor
That portion of the bed of Eagle Harbor, owned by the
State of Washington in front of Lots 8 to 14, inclusive,
Block 5, and Lot 1, Block 6, Stafford's Addition to
Winslow, a recorded plat in Government Lots 3 and 4,
Section 26, Township 25 North, Range 2 East, W.M.,
included in a tract described as follows:
Commencing at the Northwest corner of said Government
Lot 3 and running thence East along the North line,
thereof, a distance of 88.22 feet; thence S 5°09'33''
E 472.06 feet; thence S 3°29'50'' W 291.52 feet;
thence S 5044'50" E 127.69 feet, and thence S 33°07'40''
W 541.17 feet, more or less, to the Line of Extreme
Low Tide and the True Point of Beginning of this
description; thence continuing S 33o07'40" W 246.97
feet; thence N 67030' W 420 feet, more or less to a
Doint which is S 7°14'55'' W from the Southwest
corner of Lot 1, Block 6 in said Stafford's Addition
to Winslow; thence N 7°14'55'' E 126 feet, more or
less, to the Line of Extreme Low Tide and thence
Southeasterly along the Line of Extreme Low Tide to
the True Point of Beginning.
Parcel III: Tidelands
Tidelands, as conveyed by the State of Washington to
the Line of Extreme Low Tide, situate in front of,
adjacent to and abutting Lot 1, Block 6, and Lots 8,
9, 10, 11, 12, 13 and 14, Block 5, all in Stafford's
Addition to Winslow, as per plat recorded in Volume 8
of Plats, page 11, records of Kitsap County; EXCEPT
that portion, thereof, lying Easterly of the followinq
described line:
Beginning at the Northeast corner of Government Lot 3,
Section 26, Township 25 North, Range 2 East, W.M.~
thence S 0°25' E 294 feet~ thence S 89°34' W 75 feet;
thence S 19035' W 393.2 feet; thence N 81°55' W 400 feetF
thence S 13035' W 15.2 feet~ thence N 77°52'30" W 293.19
feet~
thence N 74°29' W 299.1 feet; thence S 4°31' W 291.52 feet~
thence S 6°46' E 127.69 feet to the Government Meander
Line and the beginning of said line; thence S 32006'30"
W to the Line of Extreme Low Tide and the terminus of
said line~ AND EXCEPT that portion lying Westerly of the
Southerly extension of the line between Lots 1 and 2,
Block 6 of said Addition;
All situate in Kitsap County, Washington.
SECTION 2.
All other provisions of Ordinance 74-.5 shall be deemed in
full force and effect.
SECTION 3.
This ordinance shall take effect five (5) days after its
passage, approval and publication.
