ORD 77-11 WATERWORKS UTILITY SYSTEMCITY OF WINSLOW, WASHINGTON OHDINANC No.7741 AN ORDINANCE of the City of Winslow, Washington, ordering the carrying out of that portion of the system or plan of additions to and betterments and extensions of the waterworks utility of the City, including the sanitary sewage disposal system as a part thereof, as adopted by Ordinance No. 77-2, applicable to the utility local improvement district hereinafter described, and creating Utility Local Improvement District No. 4. WHEREAS, the City of Winslow has heretofore combined its sanitary sewage disposal system and its municipal water system pursuant to law and such combined systems, including all additions thereto and betterments and extensions thereof at any time made, shall hereinafter be referred to as the "waterworks utility of the City"; and WHEREAS, pursuant to Ordinance No. 77-2, passed by the City Council and approved by the Mayor on January 17, 1977, the City Council specified and adopted a system or plan of additions to and betterments and extensions of the waterworks utility of the City and provided the method of financing the same with federal and state grants and by the issuance and sale of water and sewer revenue bonds in one or more utility local improvement districts therein authorized to be created; and WHEREAS, the City Council by Resolution No. 77-3, adopted February 22, 1977, declared its intention to initiate the formation of a utility local improvement district to be known and designated as "Utility Local Improvement District No. 4" of the City of Winslow, Washington, to carry out that portion of the system or plan of additions to and betterments and extensions of the waterworks utility of the City as adopted by Ordinance No. 77-2, applicable to a certain area outside the corporate limits of the City as hereinafter described, and fixed the 31st day of March, 1977, at 7:30 p.m., at the Wing Point Golf and Country Club, Bainbridge Island, Washington, as the time and place for hearing all matters relating to the improvement applicable to Utility Local Improvement District No. 4 and for hearing all objections thereto and for determining the method of payment for that improvement; and WHEREAS, the City Engineer caused an estimate to be made of the costs and expenses of the proposed improvement of the utility local improvement district and certified said estimate to the City Council, together with all papers and information in his possession concerning the proposed improvement, a description of the boundaries of the utility local improvement district, a statement of what portion of the cost and expense of the improvement should be borne by the property within the proposed utility local improvement district, a statement in detail of the local improvement assessments outstanding or unpaid against the properties in the proposed utility local improvement district, and a statement of the aggregate actual valuation of the real estate, including 25% of the actual valuation of the improvement in the proposed utility local improvement district according to the valuation last placed upon it for the purpose of general taxation; and WHEREAS, the estimate is accompanied by a diagram of the proposed improvement applicable to the utility local improvement district showing thereon the lots, tracts, parcels of land and other property which will be specially benefited by the proposed improvement and the estimated amount of the cost and expense thereof to be borne by each lot, tract and parcel of land or other property; and WHEREAS, due notice of the hearing upon Resolution No. 77-3 was given in the manner provided by law, and the hearing on the proposed utility local improvement district was held by the City Council on March 31, 1977, at the time and place specified, and all persons appearing at the hearing desiring to be heard were heard, and all written - 2 - protests were duly considered, and the City Council determined to make certain revisions and deletions in the scope of the improvements and the boundaries of the proposed Utility Local Improvement District No. 4 and overrule all other protests; and WHEREAS, the City Council has determined it to be in the best interest of the City that such portions of the system or plan of addi- tions to and betterments and extensions of the waterworks utility of the City as specified and adopted by Ordinance No. 77-2 be carried out and that such utility local improvement district be formed within the areas hereinafter more particularly described to secure water and sewer revenue bonds to be issued to finance a part of the cost of carrying out such portions of that system or plan; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO ORDAIN, as follows: Section 1. The City Council hereby orders the construction and installation of the improvements set forth in Exhibit A, attached hereto and by this reference made a part hereof, as specified and adopted in the system or plan of additions to and betterments and ex- tensions of the waterworks utility of the City set forth in Ordinance No. 77-2. The City may modify, change, add to or delete from the fore- going improvements if such modifications do not substantially alter the purpose of that system or plan. All of the foregoing shall be in accordance with the plans and specifications therefor prepared by the City Engineer and Roars Engineering, consulting engineers to the City. Section 2. To carry out that portion of the system or plan of additions to and betterments and extensions of the waterworks utility of the City located outside the corporate limits of the City, there is hereby created and established a utility local improvement district to be known and designated as "Utility Local Improvement District No. 4" - 3 - of the City of Winslow, Washington, the boundaries thereof being more particularly described in Exhibit B attached hereto and by this reference incorporated herein. Section 3. The estimated cost and expense of the acquisition, construction and installation of the improvements described in Section 1 and applicable to Utility Local Improvement District No. 4 is hereby declared to be $375,000, all of which less proceeds of grants received by the City therefor, shall be borne by and assessed against the pro- perties included within the Utility Local Improvement District No. 4. The properties in that utility local improvement district will be all the properties specially benefited by the improvement. The assessments shall be for the sole purpose of payment into the revenue bond redemption fund created or to be created for the payment of the revenue bonds authorized to be issued by Ordinance No. 77-2. Section 4. In accordance with the provisions of RCW 35.44,047, the City may use any method or combination of methods to compute assess- ments which may be determined to reflect fairly the special benefits to the properties being assessed.
