ORDINANCE NO. 85-4
AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON,
GRANTING PLANNED UNIT DEVELOPMENT APPROVAL FOR
CERTAIN PROPERTY LOCATED IN THE CITY OF WINSLOW AND
APPROVING A SUBSTANTIAL DEVELOPMENT PERMIT FOR THE
PROPERTY.
WHEREAS, an application was filed with the City of
Winslow seeking to develop certain property as a planned unit
development and for approval of a shoreline substantial develop-
ment permit, and
WHEREAS, the Planning Agency has reviewed the applica-
tion, drawings and other documents submitted by the applicant on
October 11, 25 and November 8, 1984, and
WHEREAS, the Hearing Examiner has held a consolidated
hearing on December 12, 1984 to consider the application, and at
the conclusion of said hearing the Hearing Examiner submitted
findings of fact, conclusions of law and recommendations, and
WHEREAS, the City Council has reviewed the recommenda-
tions of the Planning Agency and Hearing Examiner and has deter-
mined to approve the applications, subject to conditions, and
WHEREAS, the City Council finds that the applications
meet the criteria set forth in Section 18.68,060 of the Winslow
Municipal Code for planned unit developments and further finds
that the application meets the criteria and policies set forth in
Chapter 16.12 of the Winslow Municipal Code relating to substan-
tial development permits, now, therefore,
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The application for development as a planned
unit development is hereby granted for property located at 175
Parfitt Way S.W. and legally described as set forth on Exhibit A,
attached hereto and incorporated herein by this reference as if
set forth in full. The approval is subject to the limitations
and conditions set forth in the application, plans, and the
recommendations of the Planning Agency and Hearing Examiner.
Section 2. The application for shoreline management
substantial development permit for the above referenced project
is hereby approved, subject to the limitations and conditions set
forth in the application, plans and recommendations of the
Planning Agency and Hearing Examiner.
Section 3. The City Council hereby adopts the findings
of fact, conclusions of law and recommendation of the Hearing
Examiner.
Section 4. Pursuant to Section 16.12.860(N) of the
Winslow Municipal Code, the City Clerk shall transmit copies of
the original application, affidavit of public notice, site plan,
vicinity map, permit and final order to the Department of Ecology
and Attorney General within eight days of the Council's final
action.
Section 5. This ordinance shall be in full force and
effect five (5) days after passage and publication by posting as
provided by law.
