ORD 86-24 PROHIBIT MINOR CHILDREN IN WATERFRONT PARKORDINANCE NO. 86-24
AN ORDINANCE OF THE CITY OF WINSLOW,
WASHINGTON AMENDING SECTION 12.20,090 TO
PROHIBIT MINOR CHILDREN UNDER THE AGE OF 18
FROM ENTERING OR REMAINING IN EAGLE HARBOR
WATERFRONT PARK UNLESS SUCH MINOR CHILD IS
ACCOMPANIED BY HIS OR HER PARENT OR GUARDIAN;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the Winslow City Council finds that vandalism
in Eagle Harbor Waterfront Park is increasing and constitutes a
serious problem, and
WHEREAS, the Winslow City Council finds that such
vandalism is being committed primarily by minor children under
the age of 18, that such vandalism occurs primarily at night and
that detection of vandalism is more difficult at night, and
WHEREAS, the following amendments are in the best
interests of the public health, safety and general welfare, now,
therefore,
THE CITY COUNCIL OF THE CITY OF WINSLOW, ORDAINS AS
FOLLOWS:
Section 1. Section 12.20,090 of the Winslow Municipal
Code is hereby amended to read as follows:
Except for unusual and unforeseen
emergencies, parks shall be open to the
public every day of the year during
designated hours, other than as provided
in subsection B. The opening and closing
hours for each individual park shall be
posted therein for public information.
B. Minor Park Curfew
No minor child under the age of 18 shall
enter or remain in the area known as
Eagle Harbor Waterfront Park during
designated nightime hours as determined
by the Director; Provided, that a minor
child shall not be deemed to be "entering
or remaining" as used in this subsection
when such minor child is accompanied by
his or her parent or guardian.
Appropriate signs shall be placed so as
to give the public notice of the
foregoing restriction.

Section 2. If any section, sentence, clause or phrase
of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity
or constitutionality of any other section, sentence, clause or
phrase of this ordinance.
Section 3. This ordinance or a summary thereof
consisting of the title shall be published in the official
newspaper of the City, and shall take effect and be in full force
five (5) days after the date of publication.
