ORD 94-22 WATER RATE FOR ROCKAWAY BEACHORDINANCE NO. 94 - 22
A ORDINANCE of the City of Bainbridge
Island, Washington, establishing a temporary
water rate for sale of water to the Rockaway
Beach Water Association.
WHEREAS, based on a petition from the users of the Rockaway Beach
Water Association (Association) and others, on July 21, 1994 the City
did approve Ordinance 94-20 enacting a Local Improvement District (LID
#17) to allow the City to have designed and constructed a water
system, from source to individual meters, and
WHEREAS, due to the urgency of removing the Association's water system
from the "Superfund Site" wells, the City declared an emergency and
immediately entered into a construction contract for Phase I allowing
the City to provide water to the Association's undersized reservoir,
and
WHEREAS, the EPA has requested the City also provide firef low capacity
to their industrial waste facilities on the "Superfund Site", and
WHEREAS, to meet the EPA requirements the City has applied for EPA
funding which has delayed the construction of Phase II, which is the
construction of a new reservoir, new water mains to the "Superfund
Site" and to the Rockaway Beach properties, and installation of
individual meters, and
WHEREAS, the City requires the water utility to be self supporting,
with costs to be borne by the users, and
WHEREAS, due to the emergency requiring that the City provide water to
the Association's residents as soon as possible, from the time that
Phase I of the construction is complete until Phase II of the
construction is complete, it will be necessary for the City to provide
water to the Association, for resale by the Association to the
residents of the Association, and
WHEREAS, it is in the best interests of the City to provide water to
the Rockaway Beach Water Association on a temporary basis at the rate
set forth in this ordinance.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The temporary wholesale water rate for the sale of
water to the Rockaway Beach Water Association
shall be of eighty cents per 100 cubic feet
($0.80/100cf), to be billed and due monthly, in
accordance with Title 13 BIMC.
Section 2. The wholesale rate established in this Ordinance
will become effective immediately upon the
provision of water to the Association reservoir.
Section 3. The City will accrue actual cost data and will be
prepared to adopt an individual monthly rate basis
upon completion of Phase II.
Section 4. The monthly rates are to be established
independent of the LID capital costs.
Section 5. This ordinance shall become effective five days
from and after its passage, approval, and
publication as required by law.
