AN ORDINANCE of the City of Bainbridge Island, Washington,
approving and confirming the assessments and assessment roll of
Local Improvement District No. 17 for the improvement of the
Rockaway Beach area by the construction and installation of water
supply improvements, as provided by Ordinance No. 94-20, and
levying and assessing the cost and expense thereof against several
lots, tracts, parcels of land and other property as shown on the
assessment roll.
WHEREAS, the assessment roll levying the special assessments against the property
located in Local Improvement District No. 17 in the City of Bainbridge Island, Washington (the
"City"), has been filed with the City Clerk as provided by law; and
WHEREAS, notice of the time and place of the hearing and of making objections and
protests to the roll was published in the manner provided by law, fixing the time and place of
heating for February 1, 1996, 7:30 p.m., in the Bainbridge Commons, Multi-Purpose Room,
402 B'June Drive, Bainbfidge Island, Washington, and further notice of the hearing was mailed
by the City Clerk to each property owner shown on the roll; and
WHEREAS, at the time and place fixed and designated in the notice the hearing was
held; and
WHEREAS, the hearing was continued to February 15, 1996; and
WHEREAS, all written protests received were considered and all persons appearing at
the hearing who wished to be heard were heard; and
WHEREAS, the City Council, sitting and acting as a Board of Equalization for the
purpose of considering the roll and the special benefits to be received by each lot, parcel and
tract of land shown upon such roll, including the increase and enhancement of the fair market
value of each such parcel of land by reason of the improvement, determined to lower the total
amount of the assessment roll, to lower all assessments appearing on the roll, and to reduce to
zero the assessment for tax lot no. 012402-2-001-2000, owned by Michael Duppenthaler,
because the lot must be aggregated with the adjacent lot owned by Mr. Duppenthaler under City
code; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN as follows:
Section 1. The following modifications are made on the assessment roll of Local
Improvement District No. 17 (the "District"):
A. The total amount of the assessment roll is reduced from $682,509.00 to
$669,013.00.

B. The per unit assessment mount on the assessment roll is reduced from $8,750.11
to $8,688,48.00.
C. The assessment on the assessment roll for tax lot no. 012402-2-001-2000, owned
of record by Michael Duppenthaler, is reduced from $8750.11 to zero.
Section 2. The assessments and assessment roll of the District, which has been created
and established for the purpose of improving the Rockaway Beach area by the construction and
installation of water supply improvements, as provided by Ordinance No. 94-20, as the same
now stand after the modifications made in Section 1 of this ordinance, are approved and
contimed in the total amount of $669,013.00.
Section 3. Each of the lots, tracts, parcels of land and other property shown upon the
assessment roll is determined and declared to be specially benefited by the improvement in the
District in at least the amount charged against the property, and the assessment appearing against
the property is in proportion to the several assessments appearing upon the roll. There is levied
and assessed against each lot, tract or parcel of land and other property appearing upon the roll
the amount finally charged against the property.
Section 4. Each assessment against a lot, tract or parcel entitles the property to one
residential equivalent unit connection to the City's water system. The City may authorize
additional connections for such property if, at the time of the request for connection, the City
determines that the City's water system serving the area of the District can accomodate the
additional connection. For each such additional connection, the owner of the lot, tract or parcel
shall pay prior to connection (1) a charge-in-lieu of assessment equal to the per connection
assessment on the assessment roll, plus interest from the date of passage of this ordinance to
connection, or ten years, whichever is shorter, at the rate of interest on the local improvement
bonds for the District, and (2) connection fees and charges in effect at the time of connection.
Section 5. The City may authorize a lot, tract or parcel that is assigned a zero
assessment on the assessment roll or that is located outside of the District to connect to the
improvement in the District if, at the time of the request for connection, the City determines that
the City's water system serving the area of the District can accommodate the additional
connection. For each such connection, the owner of the lot, tract or parcel shall pay prior to
connection (1) a charge in-lieu of assessment equal to the per connection assessment on the
assessment roll, plus interest from the date of passage of this ordinance to connection, or ten
years, whichever is shorter, at the rate of interest on the local improvement bonds for the
District, and (2) connection fees and charges in effect at the time of connection.
Section 6. The property owned by Pacific Sound Resources Environmental Trust (Tax
Lot Nos. 352502-1-001-2001 and 352502-1-002-2001) shall be deemed to be three residential
equivalent units, and the final assessments for the property have been calculated accordingly.
The property shall be entitled to only the amount of water reasonably necessary to serve three
residential equivalent units.
Section 7. The assessment roll as approved and confirmed shall be filed with the City
Clerk for collection. The City Clerk is authorized and directed to publish notice as required by

law stating that the roll is in her hands for collection and that payment of any assessment thereon
or any portion of such assessment, including the portion authorized in Section 8 of this
ordinance, can be made at any time within thirty days from the date of first publication of such
notice without penalty, interest or cost, and that thereafter the sum remaining unpaid may be
paid in 20 equal annual installments together with interest. The estimated interest rate is stated
to be 6.5 % per annum, with the exact interest rate to be fixed in the ordinance authorizing the
issuance and sale of the local improvement bonds for the District. The first installment of
assessment on the assessment roll shall become due and payable during the thirty-day period
succeeding the date one year after the date of first publication by the City Clerk of notice that
the assessment roll is in her hands for collection and annually thereafter each succeeding
installment shall become due and payable in like manner. If the whole or any portion of the
assessment remains unpaid after the first thirty-day period, interest upon the whole unpaid sum
shall be charged at the rate as determined above, and each year thereafter one of the
installments, together with interest due on the unpaid balance, shall be collected. Any
installment not paid prior to expiration of the thirty-day period during which such installment
is due and payable shall become delinquent, and shall be subject to penalties and interest in
accordance with Section 3.48.100 of the Bainbridge Island Municipal Code. The collection of
such delinquent installments shall be enforced in the manner provided by law and
Section 3.48.110 of the Bainbridge Island Municipal Code.
Section 8. All or any lesser amount of an assessment shall be deemed to have been paid
if during the initial 30-day period during which assessments may be paid without interest the
City receives payment of 90.5 % of the amount intended to be paid. The percentage deduction
represents a return to the property owners of the contribution of the District to the LID Guaranty
Fund (for bonds) made unnecessary because of the prepayment of assessments.
