A RESOLUTION of the City of Winslow, Washington,
approving the Shoreline Substantial Development Permit under
file number SSDP-10-10-89-1 for Key's Cove Restaurant owned
by Jean King Wagoner and David E. Wagoner and located at
197 Parfitt Way.
WHEREAS Jean King Wagoner submitted an application for a shoreline substantial
development permit October, 10, 1989; and
WHEREAS the City of Winslow Planning Agency reviewed the application March
22, 1990, and offered recommendations to the heating examiner; and
WHEREAS the City of Winslow Hearing Examiner conducted a public hearing on
March 28, 1990, at which time certain documents were required to be submitted prior to the
hearing examiner rendering her report; and
WHEREAS the required documents were approved by the city engineer's office and
forwarded to the hearing examiner April 16, 1991; and
WHEREAS during the time between the hearing and issuance of the hearing
examiner's report, some facts that were listed in the hearing examiner's report changed and
were no longer valid; and
WHEREAS the city council of the City of Winslow reviewed the hearing examiner's
report August 15, 1991, and modifications to that report were approved November 7, 1991;
now, therefore,
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DOES
RESOLVE AS FOLLOWS:
Section 1. The city council amends the Findings of Fact and Recommendation and
Decision entered by the hearing examiner in the May 7, 1991, report as follows:

district is proposed at this time. Mitigation for drainage will be done through on-site
systems, as approved by the city engineer. Owners will sign a no-protest agreement
with the city for any local improvement district formed in the area of South Madison,
Parflit and Wood, that will enhance traffic flow.
Council rejects this finding.
Council corrects this finding to read as follows:
"A decorative fence is required in the parking area per WMC18.89. 100, but
the agency recommends waiving this requirement, based on the applicants'
desire to retain the property in its current natural setting and ~ letters from
adjacent property owners not objecting to the lack of a fence."
Council specifies the permit to be an occupancy permit.
The parking lot plan meets the requirements of WMC18.89.
Add a paragraph:
On January 30, 1991, a report from the Parfitt Way Neighborhood Advisory
Committee was submitted to Winslow Mayor Sam Granato specifying desired
improvements for pedestrian and vehicular circulation. Improvements specific to this
proposal would be a sidewalk along the south side of Parfitt, a cross-walk to the
Finch Place trail, and a realignment of the Parfill & Madison intersection.
RECOMMENDATIONS AND DECISIONS
1. Applicants will join with developers to the west (Harbourside, fn: SSDP10-27-89-2)
and pay a fair share to install a sidewalk along the south side of Parflit Way. The
sidewalk is to be five feet wide, made of concrete, and extend from the east property
line to the west edge of the driveway's curb and gutter.
The property owner will sign a no-protest agreement for local improvement district
formation that will run with the land, and his assigns or heirs will not protest the
formation of a local improvement district to improve Parfitt Way and utilities.
The parking lot and access road shall be designed and maintained to prevent erosion
and to permit the natural movement of groundwater pursuant to WMC 16.12.750(B. 3).
A drawing for temporary erosion and sedimentation control must be approved by the
city engineer prior to actual work beginning on the site. Plans for storm drainage
facilities must be approved by the city engineer prior to issuance of a certificate of
occupancy by the building official.
Parking lot access driveway shall be at least 20 feet wide if one-way abutted by
parking, 24 feet if two-way abutted by parking. Gravel, crushed rock or other similar
material that will minimize mud, dust, and rain water run-off will be an acceptable
alternative to asphalt paving. Detailed landscaping plans for the parking area shall be

submitted to the city and approved by the city's landscape consultant. The landscape
consultant shall follow requirements in WMC Chapter 18.90.
Utility plans shall be approved and implemented to the satisfaction of the city
engineer prior to issuance of a certificate of occupancy by the building official.
Section 2. The city council of the City of Winslow adopts the findings and
recommendations of the the Hearing Examiner except as modified by Section 1; therefore,
the permit is approved as authorized by this resolution.
Section 3. The city council of the City of Winslow authorizes Winslow Mayor Sam
Granato to sign appropriate documents approving the shoreline substantial development
permit.
Section 4. The city clerk is authorized and directed to transmit copies of the application,
affidavit of public notice, site plan, vicinity map, permit and final order to the department of
ecology and the attorney general's office within eight days of the adoption of this resolution.
