92-34 FEES CHARGED BY THE CITYRESOLUTION NO. 92 - 3 4 A RESOLUTION of the City of Bainbridge Island, Washington, establishing the amount of fees charged by the City; and establishing procedures for the collection of fees charged by the City. WHEREAS, by ordinance, the City has established fees to be charged for services provided and actions taken by the City; and WHEREAS, the City has determined that in order to recover the actual costs of the services provided or actions taken by the City, the City must raise the amount of certain existing fees charged by the City; and WHEREAS, the City desires to establish the amount of new fees charged by the City; now therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. In this Resolution, the term "incurred costs" means all amounts paid by the City to any person or entity, except amounts paid for legal fees. Section 2. Comprehensive Plan Amendment Conditional Use Permit Clearing Permit Engineering Costs: Including but not limited to review of drainage plans, circulation, and detention. Time and materials based on actual costs to the City for engineering review and approval Environmental Impact Statement, Addendum or Supplement: Deposit in City account plus time and materials for staff. Applicants shall enter into a three-party contract with the City and a consultant selected by the City to prepare the EIS, Addendum, or Supplement. Fee charges by the City for supervised monitoring of probationee's by probation officers shall be deposited into the City's current expense fund. For each individual sentence, the City shall impose a fee of $50,00 on a supervised probation term of six months or less, a fee of $100.00 on a supervised probation term of more than six F:\DMS\RAL\0011270.01 7/13/92 - 5 - Section 4. Fees charged by the City for the miscellaneous services, actions or $10.00 months up to 12 months, and a fee of $400.00 on a supervised probation term of more than 12 months. Section 6. Whenever the City is required to take action to enforce any provision of the Bainbridge Island Municipal Code, the City shall charge the person violating the code provision a fee in the amount of $75.00 per hour for all time actually spent by the City from the time the violator is notified in writing of the code violation until the time the City notifies the violator in writing that the violation has been satisfactorily corrected. Section 7. Whenever the City charges fees in relation to a project or application for a project, which are incurred on an ongoing basis, the City shall collect the fees pursuant to the following procedure: A. Fees in the amount of $100.00 or more shall be billed on a monthly basis. If the amount billed is not paid within 30 days of the date of the bill, the City shall cease work on the project or application for which the fee was incurred. If the amount billed is not paid within 60 days of the date of the bill, the application or project shall lose any priority established by the date of the project application. D$ If the amount billed is not paid within 180 days of the date of the bill, the project or application shall be cancelled, and any permits issued shall be revoked.
