RES 2004-20 SHORELINE RESTORATION & ENHANCEMENT PROJECTSRESOLUTION NO 2004-20
A RESOLUTION of the City of Bainbridge Island, Washington,
changing application fees for shoreline restoration and
enhancement projects; amending the City's Fee Schedule.
WHEREAS, the restoration and enhancement of fish and wildlife habitat, including
critical fish and wildlife habitat conservation areas, along the shoreline is necessary to restore
and conserve habitat for salmon and other fish and wildlife species listed under the US
Endangered Species Act, Washington State priority species, and species of local concern; and
WHEREAS, fish and wildlife habitat restoration and enhancement provides an important
public benefit and is a priority of the City's Comprehensive Plan and Shoreline Management
Master Program; and
WHEREAS, the Washington State Shoreline Management Act [WAC 173-27-040(2)(p)]
provides clear and consistent state-wide standards for determining fish and wildlife restoration
and enhancement projects; and
WHEREAS, the Shoreline Management Master Program [Section VII, Subsection F]
provides that fees for the filing of applications for shoreline permits and letters -of -exemption
shall be set by resolution of the City Council; now, therefore
BE IT RESOLVED BY THE CITY COUNCIL, as follows:
Section 1. The Shoreline Permits subpart of Section 9 of the City of Bainbridge Island
Fee Schedule is amended as follows:
SHORELINE PERMITS:
(Resolution No. 2003-42 & 2004-20)
Fish & wildlife habitat restoration & enhancement rojects within the jurisdiction of the
City's Shoreline Management Master Program and meeting the criteria in WAC 173-27-
040(2)(p) shall not be charged fees by the City for pre -application meetings permit
applications, or other review and authorization processes-, provided that this subsection
shall not apply to fees for the appeal of City decisions
