RES 55-05 SANITARY SEWER TO WSFRESOLUTION
BE IT RESOLVED BY THE TOWN COUNCI;L OF THE TOWN OF
WINSLOW in regular meeting, as follows:
1. It is desirable and necessary that sanitary sewer service be
extended in such a fashion as to reach and serve the Washington State Ferry
Terminal Building and the Commercial Ship Repair site, all Within the corp-
orate limits of the town of Winslow.
Z.. It is desirable to establish equitable service rates in accordance
with the ordinances of the town of Winslow in the event sanitary sewer service
is so extended.. The Washington State Ferries, Division of Washington State
Toll Bridge Authority, and Commercial Ship Repair Company, a Division of
Pacific Car & Foundry, has each indicated a desire for serlfiee and each has
informally offered a vob,ntary contribution of $4, 000.00 towards the estimated
cost, subject to the establish/nent of equitable rates for a period sufficient
to allow amortization of their voluntary contribution. I
3.i The Mayor is hereby authorized to enter into negotiations with the
proper agency of the State of Washington and with Commercial Slip Repair
Company or its legal successor, and offer to them to do the following:
(a) To plan and construct an extension of the townls
sanitary sewer lines from the nearest usable point
in the old housing project in Winslow, Washington,
east along Winslow Way to the intersection of Ferncliff
Road and thence south through the Ferry Terminal prop-
erty to a co]bcting basin and lift station at the rear of
the cate near the Ferry Dock, all in accordance with
engineerIs preliminary drawings which are attached
hereto. Sewage collected along the proposed line
would be deposited im the town~s sewage treatment
plant.~ This construction is contingent upon the
acceptability of the following provisions.1
(b) Easements necessary to implement the exten-
sion of service will be obtained by the town of Winslow.!
(c) The rates prescribed herein are specifically
approved by the Town Council pursuant to Section
511 of Ordinance No. ~-9 for the period of this con-
tract and these rates shall remain in effect until
July 31, 1961, after .which the town may estab.lish
such other rates as its ordinances may provide.
The rates shall be as follows:
(1) Washington State Ferries -- $9~i00 per mon..
(Z) Commercial Ship Repair Company -- rate is
based on n~rnber of men employed and Commercial
Ship Repair Company shall furnish to the town of
Winslow each month, +~he highest number of employees
employed by the company during that month.~ Upon
request, and after reasonable notice, the town may
once each year during the life of this agreement,
.request a verification of the number of men employed
by Commercial Ship Repair Company each month
during the calendar year.! There shall be charged
a mlnimum of $Z0.~00 per month for ZS0 men or less.i
$7.50 shall be added for each additional 100 or frac-
tion thereof up to 550 men.~ The rate shall be $5./00
for 100 or fraction thereof over 550 men calculated
only upon the excess over 550 men.i
· (d) The State of Washington shall contribute its $4,000.00
to the town of Winslow as soon as it can legally do so,~
Commercial Ship Repair Company shall contribute its
$4,000.00 to the town of Winslow when the Consulting
Engineer employed by the town of Winslow certifies to
Commercial Ship Repair Company that construction has
been commenced.:
4.: The Mayor is authorized to enter into a written service con-
tract with the State of Washington and with Commercial Ship Repair Company
containing the above provisions upon receipt of a written letter of acceptance
from Commercial Ship Repair Company and a letter of intent from the State
of Washington.
5. The contract contemplated above shall contain a provision sub-
stantially to the following effect:
"Should it be determined by the consulting engineers retained
by the town of Winslow and in their sole judgment that it is
not economical or feasible for the town to embark upon the
proposed sewer extension, then this contract is null and void,
in which event any contribution made shall be returned in full,
and the town of Winslow shah have no further liability.:"
6. The Mayor is authorized to use a copy of this resolution as
the townis offer of contract.
7.i The Mayor is authorized to take such steps as are necessary
to commence the proposed extension when and only when a written contract
is executed with Commercial Ship Repair Company, and a letter of intent is
received from the State of Washington.: The town shall have no responsibility
or liability unless bolh the written contract and the letter of intent are exe-
cuted or received.
