RES 81-03 SSDP FOR EAGLE HARBOURRESOLUTION NO. 81_ 03 . . A RESOLUTION EXTENDING FOR ONE YEAR THE SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT FOR THE EAGLE HARBOUR CONDONIMIUM WHEREAS, Winslow Ordinance 77-1 Section 7 (1) provides for extension of the duration of a Shorelines Substantial Development Permit beyond the initial 5 year period upon showing of cause; WHEREAS, Eagle Harbour Partnership, Ltd. applied by letter for a 1 year extension; WHEREAS, a public hearing was held on December 1 during which testimony was heard from the developer as well as members of the public regarding the requested extension; NOW THEREFORE BE IT RESOLVED BY TIlE CITY COUNCIL OF THE CITY OF WINSLOW AS FOLLOWS: Substantial Development Permit is hereby extended with conditions for 1 year beyond the original expiration date of October 26, 1981 to October 26, 1982. The following conditions are part of the 1 year extension: 1. Eagle Harbour Partnership, Ltd. shall make a good faith effort to insure the execution of an Easement Agreement between the Eagle Harbour Partnership, Ltd., Russell J. Trask, the Washington Toll Bridge Authority and other parties as may be required to April 1, 1981. This Agreement shall include relocation of the private road easement, maintenance of the private road, location of a City water line easement near the north and northeast property lines of the Eagle Harbour and Trask pmperties and the location of a 10' public trail easement near the north and northeast property lines of the Eagle Harbour and Trask properties. 2. The landscaped pedestrian and bicycle walkway for the public north and northeast property lines of the Eagle Harbour and Trask properties to the mid span of the bridge over the Hall Brothers slough shall be completed by September 1, 1981, provided that events beyond the control of Eagle Harbour Partnership, Ltd. (not including problems in obtaining financing ) do not operate to prevent the completion of the walkway by September 1, 1981. Plans for the bridge will be supplied by the City of Winslow. Construction of bridge and walkway must be as per City approved plans. All costs of the walkway and the midspan bridge are to be borne by the Eagle ttarbour Partnership, Ltd., 3. A bond, in an amount sufficient to cover the completion of the trail and water line (amount to be determined by the City Engineer) line must be secured by Eagle Harbour Partnership by March 1, 1981. If any of the above conditions are not complied with by the dates specified, the 1 year extension will become null and void and the original expiration date of October 26, 1981 will apply.
