A RESOLUTION APPROVING A SUBSTtNTIAL DEVEIDPMFJVF PEP~IT
FOR AN 8 MDORAGE SLIP ADDITION TO THE ~-DORAGE FACILITY
AT SUN DAY COVE
WHEREAS, application was made for a Substantial Development Permit for
an 8 moorage slip addition to the nDorage facility at Sun Day Cove
on February, 2, 1981; and
~4EREAS, Eqe Winslow Planning Agency recomrended approval of the Substantial
Developmsnt Permit on March 19, 1981; and
,Public Hearing was held by the Wins!c~; City Council on May 18, 1981;
NOW, THEREFOPdE, be it resolved by the City Council of the City of Winslow as
follows:
The City Council has made the following FindingS of Fact:
20 moorage slips and 28 residential dwelling units have been
previously approved in prior Substantial Development Permit
and Planned Unit Development application processes.
2o Approval has been previously granted by the Army CorD_ s of
Engineers for a Corps Permit for 20 moorage slips.
The developer has applied for a CorD_ s Permit for the 8 moorage
slips which are the subject of this ap.Dlication. The City of
Winslow has notified the CorDs that a Substantial Development
Permit application is pendingo
4o 10 of the residential dwelling units in Phase I of Sun Day Cove
are currently construction, 10 are occupied. No units are
constructed in M~ase IIo One unit is currently under
construction in Phase III.
5. Sun Day Cove and the 8 moorage slips which are the subject of
this Substantial Development Permit are located in a Residential
PUD and are within the P~esidential Environment as designated by
the City ' s Shoreline ~nnagenmt Master Program.
The City Council has made the following Conclusions of La~:
1o The proposed 8 unit addition to the moorage facility coreD. lies
with the spirit and intent of the City of Winslow Shoreline
~{qnag~mmnt ~4aster Program and the policies and general
regulations for developn~nt of piers and floating docks.

2. The proposed 8 unit addition must comp. ly with the applicable
General Regulations of Section J, Piers' and Floating Docks,
City of Winslow Shoreline Management Master Program. Since
the total moorage facility will have mDre than 25 moorage
slips, the additional 8 nDorage slips 'must comply with aDplicable
general regulations of Section I, }~nrinas and Corm~rcial Moorages
of the City of Winslow Shoreline Managen~nt Master Program.
3, The proposed 8 unit addition is in excess of 5 nDorage slips.
According to Ge'neral Regulations J (3) ( f), Piers and Floating
Docks, City of Winslow Shoreline Management Master Program,
facilities for handling all types of boat wastes including
operating punp out facilities must be Drovided.
4. Approval of the Corps Permit for the 8 unit addition should be
granted simultaneously with the Substantial Development Permit.
5. According to General Regulations J(3) (a) , Piers and Floating
Docks, City of W'nnslow Shoreline Management Master Program,
there shall be a maximLm of one moorage slip Der living unit
in new residential developments, In order to comply with this
provisions, no more moorage slips should be initially sold than
there are living units initially sold.
6. The purpose of a Residential PUD and the Residential Envirorm~nt
of the Shoreline T~qnagement Master Program is to Drovide an area
for primarily residential uses. Sub-letting or renting or selling
moorage slips to persons other than condominium owners would
cause excess traffic, require additional parking sDaces and
bring persons into the area for other than residential uses and
would constitute a conm~rcial use of a residential zone and
envirornnent. This is not within the intent of the Zoning Ordinance
or the Winslow Shoreline Management Master Program.
The Ci~ty Council hereby grants a Substantial DeveloDn~nt Permit for
an 8 moorage slip addition and a size increase of 8 Slips from 36' to

40' to the nDorage facility at Sun Day Cove. The following are
condi tions o f the De rn]i t:
The moorage facility shall conply with the applicable General
Regulations of Section J, Piers and Floating Docks, and Section I.
Marinas and Conmercial ~Dorages, City of Winslow Shoreline
Management ~ster Program;

2. Facilities for handling all t~vpes of boat wastes including

3~ No more 'moorage slips shall be initially sold than there are
living units initially sold.
~Dorage slips may not be owned, leased, rented or otherwise
occupied by any vessel other than one belonging to or leased
by an owner or 'renter of a condominium.
The City Council has no objection to Army CorDs of Engineers Permit
~D~ 071-0YB-1-006977 for the 8 nDorage slip addition to the Moorage
Facility at Sun Day Cove.
