RES 81-17 SSDP EAGLE HARBOUR CONDOMINIUMRESOLUTION NO. 81 _-77 A ~SOLUTION AMENDING THE SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT FOR EAGLE HARBOUR CONDOMINIUM ( FOR~4ERLY AMC O ) WHEKEAS, A Shoreline S~ubstantial Development Permit was granted for the AMCO residential condominium development on October 1, 1973; WHEREAS, A site plan for the development was approved as part of the original Shoreline Substantial Development Permit; WHEREAS, application to revise the site Dlan was submitted by the new owners, Eagle Harbour Partnership; WHEREAS, the Planning Agency considered the proposed revision and recommended approval on July 2, 1981; WItEREAS, the City Council considered the proposed revision on July 20, 1981 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WIN SLOW AS FOLLOWS: The City Council makes the following Findings of Fact: in The application for revision was properly submitted as outlined in the City of Winslow Shoreline Management Master Program° 2o The City Council had adequate information to evaluate the proposed revision~ The City Council makes the following Conclusions of Law: 1o The proposed revision is within the scope and intent of the original Shoreline Substantial Development Permit. 2. The proposed revision involves no over water construction° 3o The lot coverage and height are decreased. Resolution No. 81 -/~ page two 4o No aspects of the proposed revision are in conflict with the Master Program. 5o Landscaping is consistent with the original permit and the Master Program. 6o No additional significant adverse impact will be caused by the proposed revision. The following order is issued by the City Council: 1o Substantial Development Permit for Eagle Harbour Condominium (formerly recorded under the name AMCO) is hereby revised to incorporate the new site plan proposed which is attached hereto and is made a part o f this Resolution. 2o That portion of the pedestrian trail west of Eagle Harbour Drive must be constructed as set forth in Resolution 81-03o That portion of the pedestrian trail east of Eagle Harbour Drive must be completed before occupancy of the 2nd residential building or before September 1, 1982, which ever comes first. 3o All other aspects of the original Shoreline Substantial Development Permit are not affected by this revision nor is the extension to the permit approved by Resolution 81-03. ~~~by~/t~h~_~~ty Council of the City of Winslow this 7~ day .... ~ / , 1981o ATTEST: Donna ux on · Clerk/Treasurer A1 ice B.
