A RESOLUTION OF THE CITY OF WINSLOW, WASHINGTON,
ADOPTING FINDINGS OF FACT, CONCLUSIONS OF LAW, ~
AND ORDER IN THE MATTER OF THE SHORELINE SUBSTANTIAL
DEVELOPMENT PERMIT FOR THE WASHINGTON STATE DEPART-
MENT OF TRANSPORTATION.
WHEREAS the matter came before the Planning Agency on
April 28, 1983; and
WHEREAS the Planning Agency recommended that no formal
public hearing should be required; and
WHEREAS the Planning Agency adopted Findings of Fact,
Conclusions of Law and a Recommendation on May 26, 1983; and
WHEREAS this document was received by the City Council
and no action was taken on the matter for 30 days to allow
for public input; and
WHEREAS the Council considered the matter at its Regular
Council Meeting on July 7, 1983;
NOW, THEREFORE, be it resolved by the City Council of the
City of Winslow, Washington, as follows:
SECTION 1. The City Council adopts the Findings of Fact
and Conclusions of Law as recommended by the Planning Agency which
shall be attached to this Resolution and become a part thereof.
SECTION 2. The Shoreline Substantial Development Permit
is hereby approved with the following conditions:
1. The WSDOT shall include in its alteration of the ferry
terminal:
a. lines painted on the northeast side of the pavement
on Olympic Drive from the ferry terminal to the
existing sidewalk to make a pedestrian way;
b. a crosswalk south of the intersection of Olympic
Drive and Eagle Harbour Drive.
(Both are within the right-of-way of SR 305 and are
under the jurisdiction of the WSDOT.) No pavement
marking shall interfere with the construction of a
formal sidewalk along Olympic Way.
2. The WSDOT shall clearly show in its plans the location
of a future pedestrian overpass at the ferry terminal
to assure that the proposed project does not preclude
the future development of the overpass.
PASSED by the City Council of the City of Winslow this 28th day
of July, 1983.

This matter came before the Winslow Planning Agency at City Hall
on April 28, 1983 at 7:30 P.M.
Ben Klein of the Washington State Dept. of Transportation (WSDOT)
explained the project: automated toll gate, move existing fence
in the auto holding area to the east, build an attendant's waiting
booth, enlarge present toll booths, interior remodeling of terminal
to provide handicapped access and turnstiles, and relocate the
agent's office within the terminal. No others spoke nor submitted
information concerning the project.
The proceedings were recorded and monitored by Planning Agency
Secretary Connie Toliver.
From the testimony heard and materials submitted, the Planning
Agency makes these:
FINDINGS OF FACT
The location of the proposed project is the Winslow Ferry Terminal
owned by the WSDOT.
II.
On March 2, 1983 the applicants filed an environmental checklist
concerning the project. The lead agency, WSDOT, has made a proposed
declaration of non-significance on March 2, 1983.
III.
The City's Shoreline Management Master Program places the shoreline
of the instant property in the Urban Environment. The upland is
zoned Commercial under the Winslow Zoning Ordinance.
VI.
The governing municipal regulations in the matter are the Shoreline
Management Master Program and the Winslow Zoning Ordinance 79-15 as
amended.
The proposed project is intended to improve the efficiency of ferry
operations and reduce traffic congestion near the terminal area.
CONCLUSIONS OF LAW
Because of the above Findings of Fact, the Planning Agency has
determined that this application does not require a formal public
hearing in accordance with Section V.B.7.b. of the Shoreline
Management Master Program.

II.
The procedural requirements of the Shoreline Management Master
Program have been met and the application is properly sent to the
Winslow City Council.
III.
Remodel of the existing ferry terminal and associated facilities
is a permitted use in the Urban Environment. The application,
therefore, is eligible for approval. Therefore, the Planning
Agency of the City of Winslow makes this:
RECOMMENDATION
The following conditions apply to the approval of the Shoreline
Substantial Development Permit:
(1)
The WSDOT include in its alteration of the ferry
terminal pedestrian ways on both sides of Olympic
Drive from the terminal to Winslow Way. (This is
within the right-of-way of SR305 and is under the
jurisdiction of the WSDOT.)
(2)
The WSDOT clearly show in its plans the location of
a future pedestrian overpass at the ferry terminal
to assure that the proposed project does not preclude
the future development of the overpass.
The WSDOT representative, Mr. Klein, agreed to both of these
conditions on April 28, 1983.
