RES 85-21 REVISION TO SSDP FOR WATERFRONT PARK0045.15014 WDT:jt 10/1/85 RESOLUTION NO. 85-21 A RESOLUTION OF THE CITY OF WINSLOW, WASHING- TON, APPROVING A REVISION TO THE SUBSTANTIAL DEVELOPMENT PERMIT FOR IMPROVEMENTS AT THE CITY'S WATERFRONT PARK. WHEREAS, the City Council approved Resolution No. 85- 05 granting a substantial development permit for construction of a floating dock, boat launch and other improvements at the City's waterfront park, and WHEREAS, the City has made a revision to the project pursuant to Winslow Municipal Code Section 16.12.9A0, and WHEREAS, the citizen's committee, Planning Agency and City Council have approved the revision, and WHEREAS, the City Council has adopted Findings of Fact, Conclusions of Law and Decision, now, therefore, THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. The City Council hereby adopts those certain Findings of Fact, Conclusions of Law and Decision dated October 3 , 1985, attached hereto, labeled Exhibit A and incorporated herein by this reference as if set forth in full. Section 2. Based upon the foregoing Findings of Fact, Conclusions of Law and Decision, the City Council approves the revision to the substantial development permit as approved in Resolution No. 85- 05 Except as modified, the approval granted pursuant to Resolution No. 85-05 shall remain in full force and effect. Section 5. Pursuant to Section 16.12.940(G), the City Clerk shall send a certified copy of this resolution with the complete file to the Department of Ecology and the Attorney General. A copy of this resolution shall also be sent to persons who have notified the City of their desire to receive a copy of action taken on the original permit. RESOLVED this ~rd day of October, 1985. On March 21, 1985, the City Council approved Resolution No. 85-05 which granted approval of a shoreline substantial development permit for Waterfront Park improvements. The original permit application included a boat ramp located on the east side of the waterfront park. II. Engineering studies showed this was not the optimum location for the boat ramp due to slope and soil conditions. III. A revised shoreline substantial development permit application and environmental checklist were submitted on September 9, 1985. IV. The revised permit shows this boat launch ramp located on the west side of the park, adjacent to the moorage dock. Undercutting of the bank has caused erosion and loss of ground and trees on the shoreline of the park east of the area where the boat launch and moorage facility will be located. VI. The revised permit shows a three-foot riprap bulkhead to prevent further undercutting. VII. The Citizens Committee approved the revision and submitted a letter dated July 30, 1985, and re-confirmed that approval in a letter dated September 9, 1985, documenting that action. VIII. The City's Responsible Official issued an addendum on September 9, 1985, to the March 4, 1985 Final Declaration of Nonsignificance after reviewing the environmental checklist submitted for the request for revision of the shoreline substantial development permit per Resolution No. 85-05. IX. The Planning Agency considered the revision at its September 12, 1985 meeting and unanimously approved it. X. The City Council considered the revision at its September 19, 1985 meeting and unanimously approved. XI. For present anticipated needs, there are sufficient existing and planned parking spaces for cars and boat trailers. CONCLUSIONS OF LAW The Planning Agency found that the revisions were consistent with the criteria contained in Winslow Municipal Code (WMC) Section 16.12.940. II. The City Council finds that the revisions are consistent with the criteria contained in W'MC 16.12.940. DECISION The revision to the Shoreline Substantial Development Permit is hereby approved as submitted. Except as revised, the approval granted in Resolution No. 85-05 shall remain in full force and effect. Approved by the City Council this 3rd day of October, 1985. F~ederick W.
