A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WINSLOW,
WASHINGTON, APPROVING THE SUBSTANTIAL DEVELOPMENT PERMIT
SOUGHT BY MATT SVORNICH.
WHEREAS, Matt Svornich has made application to the City for
a shoreline management substantial development permit, and
WHEREAS, the Planning Agency has reviewed this application
on October 24, 1985, and in following the provisions of WMC 16.12.860(H),
the Agency determined no formal public hearing before the Hearing
Examiner was required, snd,
WHEREAS, the Planning Agency has made Findings of Fact,
Conclusions of Law and Recommendation, and
WHEREAS, based upon the Findings of Fact and Conclusions
of Law, the Council finds that the application meets the criteria set
forth in Chapter 16.12 of the Winslow Municipal Code relating to
substantial development permits, now, therefore,
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, HEREBY
RESOLVES AS FOLLOWS:
Section 1. The City Council hereby incorporates those
Findings of Fact, Conclusions of Law and Recommendation dated
November 1, 1985, attached hereto, labeled Exhibit A and incorporated
herein by this reference as if set forth in full.
Section 2. Based upon the foregoing Findings of Fact,
the City Council approved the application for substantial development
permit as set forth in the Findings of Fact, Conclusions of Law and
Recommendation.
Section 3. Pursuant to Section 16.12.806(N) of the Winslow
Municipal Code, the City Clerk shall transmit copies of the original
application, affidavit of public notice, site plan, vicinity map,
permit and this resolution to the Department of Ecology and Attorney
General within 8 days of the Council's final action.

Development Permit
November I, 1985
Findings of Facts
The application request is for a private, residential boat dock for
the Svornich residence, at 567 Stetson Place SW, located along the
waterfront and within the waters of Eagle Harbor. The project
description is attached as Exhibit A and the drawing is Exhibit B.
Notice of a application for a Shoreline Substantial Development Permit
was published in the Bainbridqe Review, with a 30 day comment period,
for two consecutive weeks, commencing September II, 1985 and ending
September 18, 1985. Notices were also posted in several conspicuous
place on the property.

The S.E.P.A Official made a determination of non-signifiance for the
project, with a 15 day comment period.
IV
At their regular meeting on October 2u,, 1985, the Plannin9 Agency
reviewed the permit request and applied the appropriate provisions
of the city adopted Shoreline Master Program, specifically:
WMC 16.12.580-Policies for Environment;
WMC 16.12.620 Use Activities and Regulations regardin9 piers in
the residential designations,;
WMC 16.12,720 Piers and floatin9 docks,

The Agency followed the provisions of WMC 16.12.860(H) to de-
termine if a formal public hearing before the Hearing Examiner
was required.

Staff reported that no public comments, either written or oral,
were presented to the Land Use Department regarding this project.
CONCLUSION
The permit request for a pier and dock is allowed in the Residential
Designation of the Shoreline Master Plan, per WMCI6.12.620,
The Land Use Department recommended approval of the application.
The project will secure the proper construction permits and follow
the applicable standards.

The Agency understood that the requested project apparently did
not generate public concern in the immediate vincinity. Therefore,
the Agency unanimously agreed to not require a public hearing before
the Hearing Examiner.

The Agency approves the permit as submitted and detailed in Exhibit A
and the Exhibit B. Therefore, the Agency invoked the opportunity
to prepare their findings of fact,conclusion, and recommendation for the
City Council for their review and consideration.
RECOMMENDATION
Application for the pri vate, residential boat dock as submitted should
be granted.
