RES 94-07 APPROVAL OF PRELIMINARY PLAT OF BAYVIEW SUBDIVISIONRESOLUTION NO. 94-07
A RESOLUTION Of the City of Bainbridge Island,
Washington, approving the preliminary plat of
Bayview Subdivision on approximately 11.5 acres
of real property bounded by Wyatt Way on the
north and Eagle Harbor on the south, upon the
application of Edward Fisher (file #SSDP01-30-90-1).
WHEREAS, Edward Fisher submitted an application of
preliminary plat; and
WHEREAS, the preliminary plat application is submitted to
develop a plat of 19 single family lots on 11.5 acres of real
property bounded by Wyatt Way on the north and Eagle Harbor on the
south; and
WHEREAS, the Bainbridge Island Planning
reviewed the preliminary plat application and
conditioned approval to the Hearing Examiner; and
Commission
recommended
WHEREAS, on June 8, 1992, the Hearing Examiner conducted
a public hearing on the preliminary plat application upon proper
notice; and
WHEREAS, on August 3, 1992, the Hearing Examiner
recommended conditioned approval of the preliminary plat, and
entered a report, Findings of Fact, Conclusions of Law and
Recommendations; and
WHEREAS, on February 3, 1994, the Bainbridge Island City
Council considered the recommendations of the Hearing Examiner and
determined that it was in the public interest to adopt the Findings
of Fact, Conclusions of Law and Recommendations of the Hearing
Examiner; now therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES RESOLVE AS FOLLOWS:
Section 1. The Findings of Fact, Conclusions of Law and
Recommendations of the Hearing Examiner (SSDPO1-30-90-1), as set
forth in Exhibit "A", which is attached and incorporated by
reference is adopted as the final decision of the Bainbridge Island
City Council together with the following clarifications:
Recommendation #17, shall be construed to include
comments from the City Engineer in a memo dated
October 11, 1992, regarding a possible need to
enlarge the water line on Wyatt Way.
Recommendation #22, shall be construed include all
heirs and assigns to Mr. Fisher for not
protesting formation of a Local Improvement District
in the area.
Construction drawings shall be approved by the City
Engineer and Planning Director prior to
commencing work. Minor changes found to be necessary
by the City Engineer and approved by the Planning
Director may be executed during the construction
phase.
The plans viewed by the Hearing Examiner showed a 40-
foot-wide area west of Lot 7, in which pedestrian
access to the beach and a portion of the drainage
system was to be located. The current plat plan
shall be revised to restore as much of this 40 foot
width without bringing the south property line
farther toward the water or the lot size below
the 15,000 square foot requirement.
Recommendation #22, shall be clarified as follows:
Lot lines for Lots 10, 14, 15, and 19, shall be
redrawn to exclude the 50 foot buffer area.
Recommendation #12, shall be clarified as follows:
The trail adjacent to Lots 5, 16, 17, and 18, shall
be delineated in such a manner that its boundaries
are apparent and shall, at the option of the City at
Final Plat approval, be deeded to the City.
Section 2. The proposed subdivision is in conformity
with the Zoning Ordinance (Ordinance No. 87-30), the Comprehensive
Plan (Ordinance No. 87-29), the subdivision regulations (BIMC
17.04), and Subdivision Standards (Ordinance No. 84-10), and all
other applicable land use ordinances.
Section 3. The final plat of Bayview Subdivision
shall state on its face that it is subject to the conditions of
approval set forth in this resolution.
PASSED by the City Council of the City of Bainbridge
Island, Washington, this 3rd day of February, 1994.
