A RESOLUTION OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, SCHEDULING A PUBLIC
HEARING IN THE REQUEST TO VACATE PUBLIC
RIGHT-OF-WAY, BAKER ROAD.
WHEREAS, the Washington Department of Transportation (WSDOT) has
petitioned the City to vacate a portion of Baker Road, near Lynwood
Center, to develop an estuary and stream restoration as mitigation
for cleanup activities at the Eagle Harbor Superfund Site, and
WHEREAS, the cleanup activities will take place to provide
Washington Department of Transportation/Washington State Ferries
(WSDOT/WSF) utilization of the WSF property adjacent to the Ferry
Terminal, and
WHEREAS, the mitigation will provide the City a tremendous public
benefit to the Island citizenry in the form of restoration of an
environmentally endangered area.
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DOES RESOLVE AS FOLLOWS:
Section 1. The City Council does establish a public hearing
before the full City Council for Thursday, January 4, 1996.

I have received the requests from both the State Department of Transportation and the
current adjoining property owners requesting the City's vacation of the unopened right
of way that bisects the property proposed for the mitigation of the nearshore fill.
I will recommend to the City Council that they initiate the vacation process.

Dear Mr. Bryan:
This letter is serves to request-the abandonment by resolution of Baker Road right-Of-way
north-of Point White Drive N:'E. and south of Baker Hill Road in southern Bainb~ge
Island. The portion of fight-of-way is legally described as:
That portion of right-of-way known as Baker Road, recorded under
Auditor's file #804507, lying northerly of.the north margin of Point White
Drive N. E., and southerly of the south margin of Baker Hill Road N. E.,
situate in Government Lot 4, Section 4, Township 24 North, Range 2 East,
W. M., City of Bainbridge Island, Kitsap County, Washington.
This request is being made concurrently by the Washington State Department of
Transportation (WSDOT) and the adjacent propert,j owners, Lovell Associates, Inc., a
Washington Corporation, G. Gale and Marja Cool, husband and wife, and Richard and
Sarah Dunbar, husband and wife.
The right-of-way lies within the area proposed for development of an estuary and stream
restoration project proposed by the Washington State Ferries as mitigation for cleanup
activities at the Eagle Harbor Superfund Site, West Harbor Operable Unit. The existence
of the right-of-way is inconsistent with this mitigation and restoration use. The-'
abandonment of this fight-of-way is necessary to ensure the future long-term viability of
the estuary and Stream project.
